Hello,
I just moved into the Southern Walk which is at the other end of Claireborne Parkway. We almost did not goto settlemnet because of something that was not pointed out to us when we bought our property/house. They are putting in a ten foot trail right behind our houses.. I am wandering if anyone else has heard anything about this? We are not allowed to put up fences in this neighborhood, and we would never bought this house if we knew. Also the fact that we paid a premimum price to back to woods...If anyone has any information about this please let me know.

Welcome to the Broadlands! Are you sure about the no fences? I thought you could? Might want to ask on the new forum for homeowners. We have a trail behind my house, it's actually a very nice thing to be next to.

I am sorry but we paid alot of money to back to woods. Also where we bought these are extremly tiny lots it would feel like someone was walking in my backyard...

You home has a trail in the back yard? Hey! live in it for a year and then sell.
You will make a pile of $$$. Just be glad you did not find out you were getting a hospital in your back yard, huh?

Tracey, you say that your property "backs to woods". Will this new trail be directly off your property or will it be seperated by a certain amount of "wooded space"? If there will be a strip of "wooded area" between your property and the trail, then I'm not sure that you have a big issue here...
This trail you are talking about; is it a dirt trail or "asphalt"? All trails in Broadlands are pretty well indicated on the site maps at the Broadlands Visitor Centers. In fact, they are pretty prominently featured since they are a "positive feature" in regards to our community.
I have a trail directly behind our house, seperated by a very thin wooded area. In the summer, it's no big deal because of the vegetation. In the winter, it's wide open, but the trails are not used as often during cold weather, so it's not really a big deal. In fact, it's actually nice to see the neighbors walk by, wave, and chat. Also, the constant possibility of a neighbor walking their dog on the trail or taking an eveining walk is, to me, a good deterent to crime.
As for the fence issue, it's the first time I have heard of such a thing. Where is this 'rule' which states that you are not permitted to put up a fence? Also, if the wooded area behind your house is so important, why put up a fence in the first place?
Finally, a quick comment to "SK8R": While the moderators are not in the business of telling people what to post or how to post, I would suggest you try to be a little bit more 'constructive' with your comments... Let's try to help Tracey and not furthur frustrate her...

My comment was certainly not intended to frustrate Tracy in her situation.
There are many home purchasers in Broadlands that paid a "premium" for a lot that does not seem to be worth the extra $. Somehow the builder made it seem like this was a better lot. There are some very challenging lots in Broadlands, and some homeowners have realized some very shocking "surprises", though, after they moved in.
I agree that the lots with any sort of "woods" are more desirable, no matter where you are. However, I sympathize with Tracy that her lot is so tiny. The developer just tried to get as many houses in as possible.
I know quite a bit about landscaping and I have owned some very challenging properties over the past 15 years. I would be glad to help Tracy figure out some landscaping ideas in order to create some privacy from this trail that is so close her property line. I see that Tracy has her phone # posted and I would be glad to call her and help her if she would like my help. Landscaping is a great hobby of mine.
My comment about selling in a year and making a pile of $$ was not intended to be "unconstructive". There are some very undesirable properties
in Broadlands. The ones with the woods and trail seem to have very high and fast resale. I thought that would be reassuring for Tracy, seeing that she just spent a tremendous amount of money on her lovely new home, and then to have this frightening discovery in her back yard.
This comment was meant to be reassuring.
Those homeowners that live near the proposed hospital site have some serious churning in their stomachs and landscaping is not going to help
them.

just an FYI to anyone regarding selling of property prior to living in it for 2 full years, you have to pay capital gains taxes on the profit EVEN if you roll ALL of it into another property immediatly (as I did). I found this out the hard way last year.
just spreading the word because most people don't know about this tax law.

and not your residence. You have a $500,000 per individual exemption.
Speak to yur tax lawyer.

I wish it was true :(
that was the old law .... this is a new law and was informed by a reputable accountant who did the research ... he was surprised too.

It would be my pleasure to help you figure out some ways to create a little bit of privacy in
your yard. If you do not need my help, I won't be offended. (I have teen-agers, I don't get offended anymore!) Since you can not put up a fence, you could create a pretty barrier with the right plantings. Take a visit to Bluemount Nursery on rt. 7. They could help you as well.

I"m very amazed at how many people do not know this. It was outlined in the TRA97 changes. The 500K is only for married couples who file jointly (250K per tax payer). You must maintain the property as a principle residence for a minimum of two of the last 5 years. Meaning if you lived in it for 2 yrs then rented it out for 2, you can still claim the exemption.
