Southern Walk Board of Directors Announcement Regarding OpenBand Easement Exclusivity Purchase

    On Friday, July 20, 2018, the Southern Walk HOA and OpenBand completed a thirty-nine month transition period, following the termination of the OpenBand mandatory bulk billing contract, by paying OpenBand the sum of $1,000,800 through the services of legal professionals for both OpenBand and the Southern Walk. The payment to OpenBand sets forth the following actions and conditions:

    • OpenBand retains the non-exclusive right to remain in the Southern Walk as a telecommunications utility provider on a perpetual basis;
    • Amends the blanket easements conveyed to OpenBand in 2001 to alternate fixed-length/width utility easements, and recorded in them in the Loudoun County land records;
    • Conveys any remaining “reserved easement rights” for the Southern Walk directly to the Southern Walk HOA for the purposes of executing the amended easements.
    Negotiations between the various entities listed above occurred over the course of several months, although the nine-month window to work directly with OpenBand spanned between late October 2017 and late July 2018. The Southern Walk HOA Board of Directors directly engaged with the Broadlands HOA at their monthly Board of Directors meetings over the past several months because the Broadlands Association is the Master Association in the Southern Walk Articles of Incorporation and original grantors of the easements to OpenBand, along with the Southern Walk and VanMetre. The Broadlands Association President and Southern Walk President signed the official documentation on Wednesday July 18th at the Nature Center in Broadlands while other parties signed at their respective places of business and the deal closed at a legal firm in Northern Virginia and was recorded in the Loudoun County land records.

    In completing this transaction, the Southern Walk HOA purchased the exclusivity rights of OpenBand, which sets forth the terms listed above and opens the neighborhood to other providers.

    The Southern Walk HOA will continue to share relevant details about any new providers at Board meetings and via emails, forum posts, and other communication means as official details become available.

    is this means I can only select other ISP after 39 month transition period?

    No, the transition period is over. You still can only select from ISPs offering service to your address.. which has not changed with this last milestone.

    Indeed, I call FIOS which told me today the only provider in my address is OpenBand, but from the follow link, looks been covered by Fios already, so confuse.

    The board is working on getting a provider lined up to replace openband (Verizon).

    What do you mean contact OpenBand? Are you saying you are new to the neighborhood and haven't yet made the call to request internet, cable, phone? Yes, currently, OpenBand is currently the only option in the SW. The currently is expected to change and the SW Board will make announcements about this.

    yes, I am new to the community.

    BTW, how to control the light in front my townhouse? there is light/move sensor, but seems do not work, when neighbor lights are on in the evening, mine light still off, is there another switch somewhere? or if it's broken, need to buy a new sensor switch?

    And Winston, for Internet you are stuck (for now) with Openband. But for TV you could choose DirecTV (satellite) as an option. Home phone could be voice over IP and also purchased through AT&T, Google or similar providers...
