HOA considering restrictions on home-based businesses? (merged)

    Personally, I don't think the HOA should be getting involved in regulating the amount of traffic on a street. We have existing zoning regulations at the county level, I think it should be handled at the county level.

    Maybe the HOA can supply us with universal healthcare too.

    I don't like the idea of the HOA making the use of our homes any more restrictive. There have been MANY reports of HOA boards out of control. This particular Board is very responsible IMO but, who knows who might be in control in the future?

    No, but it could be me taking a day or two off of work to have several contractors come and repair things. For example, I'm planning on taking a personal day soon to have my sprinkler system repaired, work completed on our basement finishing project, our gutters cleaned, Mr. Handyman to repair things around my house, and my dry cleaning will probably be picked up that day as well. My sprinkler system company usually comes in multiple vehicles, and our basement work usually includes multiple vehicles coming and going. Oh, and I have a cleaning service regularly visit and they come in seperate vehicles.

    Should I instead have to take multiple days off from work over the course of a few weeks in order to space out the number of trips made to my house by non-residents?!?

    Plus, I have loads of family in town and they regularly visit as well. Should I tell my son that his aunt and uncle can't visit b/c we've already met our quota on the number of visitors for that week? Crazy!

    No one is approaching the board about universal healthcare. They approached the board about traffic levels going to a home-based business. I don't see why that is so hard to understand.

    Ok, you say you don't like the idea of the HOA making the use of our homes any more restrictive.

    So you don't mind if a day care, or even several day cares, open up on your street and over 200 more cars appear every week, with lines of cars 15-30 deep every morning and afternoon? You wouldn't have a problem with that at all?

    And unless things change, the 'who in control' is still the same people that you elect to the position. :)

    Are you running a home business licensed by the county as such?

    No need to be threatening, but I could be running a home-based business....never said I wasn't. Regardless, as long as a home-based business meets county/state/federal laws, I'm totally cool. Home-based/Small businesses are what makes this country great.

    I'm not trying to be threatening. Just trying to get people to stay on topic. I'm just amazed how many pages this thread has gone with people going so far off topic, with asking for rules, laws etc etc on things that the HOA board isn't even investigating on this issue.

    Hyperbole my friend!! I didn't say I wouldn't have a problem with it. I said I don't want the HOA involving itself. We have a county government that regulates home businesses.

    The point is to keep the regulation where it belongs -- at the county level. It's not that I wouldn't mind, it's that I don't think it's necessary to get multiple levels of regulations imposed. If the county regulations are not good enough, change them. Don't add another layer of bureaucracy at the HOA level.

    If that were the case, why would there be a need for HOAs covents at all? Just get the county to enforce the rules every community wants?

    The county laws are way less restrictive on signs - do we need rules on that?
    What about lawn care? Why have we added 'layers of bureaucracy'?

    Because there are TONS of examples where the county regulations are NOT strict enough for many people and they are never going to be.

    The existence of county limits does not preclude the desire of some to have limits beyond those. Take your pick of examples...

    Dude, my brothers are like a swarm of bees. They recurringly visit our house...sometimes multiple times a day. We're a very tight family!

    Sounds like you all have some very buzy days. I bet a nice trip to the pub takes the sting out of all the stress!

    But I'd choose a different word for the vast majority of this entire thread. 'Irrelevant'.

    Not completely accurate. The majority of the Board is made up of Van Metre employees. We didn't vote for any of them.
    Given that they (the Developer) wrote the documents which specifically included language regarding home businesses and daycares and given that they have kept the majority vote on the Board, I expect them to take the lead on this issue.

    Does anyone have any updates on this situation? Is the daycare up and running and the problems have gone away? Did it get shut down?

    You really struck a nerve with me, so here goes. When the licensing is complete, your issues with "traffic" and licensing may well subside. By the way, depending on the care she offers, she can be registered with the County, she doesn't have to be licensed. [Unlicensed child care includes child care that is not required by law to be registered or certified. This type of child care includes religious exempt child day centers, voluntarily registered family day homes and certified preschools. Other forms of unlicensed care not included on this Web site are homes approved by family day care systems, child care providers approved by local departments of social services, and child care providers that are not subject to any form of regulation.]

    The BIG issue here is too much buttinsky.....How on Earth do you know that they won't foreclose on their home if they do not generate income from this daycare? How could you possibly know that, did you do their taxes? And it's not Mrs. Baker that is speeding up and down your street. She tells her clients to drive carefully and slowly. Maybe you don't like her, maybe you don't like me, but this is America where we should all be able to live free and prosper. Many of my immediate neighbors are self employed, work from wherever and the last thing we need is our HOA or our neighbors telling us they oppose our earning a living. That's completely bogus!

    This neighborhood desperately needs more DAYCARE SOLUTIONS, Preschool, whatever. The ones existing simply cannot meet the demand. I also know a daycare provider in Lansdowne, who still operates even though she is breaking the rules now. You know why??? The answer is threefold; her clients DEPEND on her to provide a safe place for their kids, there aren't available spaces in other facilities AND she bought a big home with the okay to operate a business, and if that business goes away, just add another foreclosure to the many in this area...20% in 20148 alone!

    Be careful what you wish for, your taxes have gone up and your values have gone down, and a foreclosure makes it that much worse. And finally, maybe you don't work or don't have young children, or have so much money that you can't understand why others need to work, I just don't know. What I do know is that is has become increasingly difficult to find childcare without spending $800+ per month. Little Sprouts is providing a needed service with no ill-intention.

    Have the parents walk the kids down the street, problem solved.
