    Southern Walk Litigation Budget Details:

    2011: $230,892.00
    2012: $100,000.00
    2013: $453,236.23
    2014: $302,000.00

    Total: $1,086,128.23

Southern Walk residents wake up and take control. That is almost $1000 per household.

    Is it sheer incompetence?

    How do you justify this?

    How? How? How?

Could the lawyers have found a perfect billing machine without any accountability?

According the court documents, Landsdown spent $813,000 for the Federal Court phase of this case. Since they won their case, they were awarded $615,000 in legal fees from Openband.
    Landsdowne's final cost of litigating in the Federal courts is : $813,000 - $615,000 = $198,000

If our HOA directors put aside their personality differences and filed a combined litigation with Landsdowne, in the best interest of the community, our final litigation cost could have been about 1/3rd of $198k.

Everyone please keep in mind that our elected leaders have tried their best. Of course things have not gone as planned but they are all volunteers, many of whom have put in countless hours on this. The end of the Open Band contracts and easements could save each family far far more then what we have invested. Hopefully this all can be finalized soon so that our community can start to be just that again.

"But they're trying so hard!" isn't a valid excuse for wasting upwards of $1M. Community leaders are responsible to their community and the SWHOA has made every effort to not be responsible. Their inane treehouse secrecy, lack of communication and bizarre perspective on legal strategy is representative of neither their constituents' interests nor the board's fiduciary responsibility.

Apologism and tone policing do not excuse the board's behavior.
