Boadlands OWNS "Living in LoCo"

    In response to Kaos' acrimonious attack on the Farm.

    Well then, I am glad we finally got rid of you. :) Just kidding we miss you.

    For the record, flower planting is encouraged in Ashburn Farm and does not require, nor ever did require written HOA approval. You most likely are confusing the issue with bushes and trees which there are guidelines for.

    For the record, permission is not needed from an HOA to sell your house. What is required by the law, as documented in the Commonwealth's Virginia Property Owners Association Act is a disclosure:

    § 55-511. Contract disclosure statement; right of cancellation.

    A. Subject to the provisions of subsection F of § 55-512, a person selling a lot shall disclose in the contract that (i)
    the lot is located within a development which is subject to the Virginia Property Owners' Association Act; (ii) the
    Act requires the seller to obtain from the property owners' association an association disclosure packet and provide it
    to the purchaser; (iii) the purchaser may cancel the contract within three days after receiving the association
    disclosure packet or being notified that the association disclosure packet will not be available; (iv) if the purchaser
    has received the association disclosure packet, the purchaser has a right to request an update of such disclosure
    packet in accordance with § 55-512; and (v) the right to receive the association disclosure packet and the right to
    cancel the contract are waived conclusively if not exercised before settlement.

    The HOA is required by law to provide you this disclosure, which then is provided to the buyer. It is not an "approval" to sell your property.

    You'll find the same law applies to Broadlands. In fact, you should have gotten one as a purchaser when you moved into Broadlands.

    Without additional details about your "severe safety issue", I can't comment.

    p.s. one caveat on the flowers, don't put any rock mulch around them :)

    I know about the disclosure form - it's so we can get the full packet of goop to hand to the new buyer. What I am saying is that there was (may not still be there) a form that had to be filed with the HOA informing them and asking permission to sell the home. It gave them the right to inspect the property and deny the ability to sell (at least that's how it was explained to me).

    Anyway - as I know one of the folks on the board for AF I'm almost certain that it's the by-laws have been trimmed back to a more reasonable level. Not becuase I know him but because I know he's a reasonable kind of guy.

    I will close with one more caveat - When we lived in AF there was still a LOT of construction going on and many instances of "No, you need to talk to the builder/HOA (depending on whom you were speaking with) about that." At one point I was even told by the HOA that my neighborhood was not part of the HOA. So. there was obviously, a lot of very comfuzzled folks.

    OK, my comments about the AF HOA were based on past events and were unfair. I have edited the post to remove those comments and I apologize for any ruffled feathers.

    Very mature and admirbale response. If someone says something that is inadvertently offensive, the person generally apologizes like you did even if you maintain that you did not try to offend. It's just the right thing to do.

    However, if someone is just trying to be offensive, they say something clearly offensive with the intent to incite and never back off. I'm glad to see that you are a stand-up type of guy as opposed to certain other people.

    You actually may have a point there. I have horrible typing skills and that may or may not corelate to the loss of brain I have incurred. Or I may just be a bad speller.
