HOA considering restrictions on home-based businesses? (merged)

    Thanks for your post. I don't understand your comment above. What has been addressed formally by the HOA? I don't think that anyone can say that this issue has been addressed until we see the wording of the new restrictions.

    As a next step, I suggest that the people who want new restrictions post their desired language here, so we can all review it and make up our own minds about what it affected or not.

    It's not clear at all. One thing that would make it clear is for someone to post the text of the restriction they want to be imposed. Another thing that would make it clear is for the HOA to issue a statement that all of the members of the board guarantee that telecommuting and other home-based business activities will never be banned unless they are illegal.

    Resident's aren't writing the rules mr. spin. You can keep beating that drum all you want - but no one here has claimed to draft a resolution, nor would most expect anyone to.

    They are talking about what results they desire and what methods could be used to get them. If you can't interpret those posts to get what 'rules' people are suggesting then maybe you should goto the meeting and ask the people to clarify - because you obviously can't read what you desire from the posts. Keep asking people to post what they've already posted isn't answering anything.

    If you want a clarification from the HOA - you can try to stop hiding and go ask in front of the board or write a letter and do the same.

    does 'telecommuting' also mean incessant posting of the same drivel on HOA forums while one is supposed to be 'working from home' :D

    Thanks for doing what several of us have been asking for! Gosh, I guess it is not so hard after all. Once again, Lee rules and does what other people just could not simply be bothered to do!

    I've read this restriction, and it sounds pretty reasonable. I think that the term "large number of vehicles" needs to be clarified, though, if it is going to be adopted for the Broadlands.

    Exactly Lee - because what you cut and pasted is basically the same restrictions the county has on in-home business. So in effect, the regency is stating nothing beyond the county laws except for a catch-all clause.

    See page 34 of Loudoun's Guide to Doing Business in Loudoun

    Edit: update - one difference is the regency does not allow any sign, where the county does. But that is already covered by other rules in the community.

    The Regency's definition that does not address some of the complaints existing in the community. For instance, frequent sales parties some people hold in their home. It is not clear to me without calling the B&D Office myself that if such parties require a home occupancy permit. Given most of these probably are not even businesses in their own right (operating as employees, not a self-owned business) they probably don't even need a business license.

    Also, Mrs. Baker or whomever can give us any language they want. Sure, it will be considered, but it's the HOA that makes, writes, enacts and enforces the rules.

    Please indicate to me how you would expect the HOA to enforce a 'no telecommuting' rule, as you are suggesting? That's pure gibberish and simply a way for you to fan the flames on these forums, something your posting history has shown to be something you enjoy to do.

    How about this; if the HOA were to ever make Telecommuting 'against HOA rules', and I am still on the Board, I will officially step down as a Resident Board member. Are you willing to give up anything if we DON'T pass such a rule? Your postings seem to indicate that you feel strongly that we're going to pass such a rule, otherwise you wouldn't keep bringing it up.

    Do you really think the Board members are DUMB ENOUGH to make Telecommuting against HOA rules? First, it would be an unenforceable rule. Second, telecommuting has NO IMPACT on the quality of life of your neighbors; it's basically you working from home, using your phone and/or computer and MAYBE getting the occaisonal co-worker stop by...

    I'm amazed at just how illogical you can be at times. Do you actually think the four Resident Members are so incompetant as to pass such a rule? Really? If that's what you're actually trying to say, then state it outright. Otherwise, quit it with the nonsense about Telecommuting being something we would even consider passing a rule against...

    Geeez, it really blows my mind how some people extrapolate things just to start a flame war on these forums...

    Bothered? They were the ones who actually went to the HOA meeting where the very terminology WAS discussed. Sorry you weren't 'bothered' to be there yourself.

    This only takes the discussion BACKWARDS - those overly simplistic rules are essentially the same as ours except for the traffic clause - which is where the whole debate comes up. The county guideline for permiting is also extremely vague.

    "The home business cannot generate traffic volumes higher than
    would normally be expected in the residential neighborhood.
    Any need for parking generated by conducting the home
    occupation shall be met by off-street parking in an area other
    than the front yard;"

    So what is 'normally be expected in the residential neighborhood' ? Welcome to the start of the debate.

    Jeez.. see what happens when you actually LISTEN to the conversation?

    There are "DUMB" laws on the books for places in the United States that have been there for decades, maybe centuries but no one has taken the time to correct. For example, my coworker bought a house where a "Black" family could not purchase the property. He had them change that so anyone could buy his house. How about a barber given a citation for cutting hair on a Sunday/Monday? I could continue but I hope you see the point. Like it or not certain verbage could have an effect on other things thoughout the Broadlands. That is why clarification is requested.

    So you think our HOA board is so stupid to make dumb laws like this? And how many times does it have to be said that there is no clarification by the board on any of this? What you are requesting doesn't exist yet.

    This is unbelievable. My co-workers laughed so hard about this thread today, I had to show it to them to swear I wasn't making this stuff up.

    Lets just go ahead and say it.

    YES - the HOA board is banning all home-based business! You can no longer telecommute! The HOA is going to hire 150 people to knock on everyones door at 9am to make sure that you are not working from home! If a girl scout walks up to your door to sell cookies call the police! If you host a tea party for 2 of your friends they have to park at the Community Center then walk to your house!

    This is a laugh riot. I swear I thought I moved into an intelligent community.

    Mr. Linux, I joined in March, but lurked for much longer. I had chosen to keep my opinions to myself but after seeing some of the posting I decided to join. I have seen posts from many here that are meant to inflame or anger some. I too brought up the telecommuting because like I pointed out earlier certain rules while meant to heal some may well hurt others. I agree that enforcing the telecommuting would be very hard to enforce. As a matter of fact, I'm jealous of those who can work from home.

    I don't really think the point is valid. You are talking about very old laws that may have not been "dumb" at the time they were passed but the course of time has changed the "dumbness" of the law. I think what's being discussed here is a request for a potential rule that makes sense TODAY. Will it make sense 30 years from now? Who knows. Does it matter? Not really as it can be changed in 30 years if it becomes outdated.
