HOA Violations, only a select few?

    They wear bright orange safety vests that say Broadlands HOA Covenants Inspector on the back, they are hard to miss.

    Just voicing my concern that the HOA representatives entering properties and fences should be wearing vests of some type labelled HOA. We had a situation where a concerned neighbor called me saying that some "joggers" were going on my front yard and around the back. She was about to call the sheriff's office for suspicious activity!! It is one thing to have the right to enter a property, but it is another to do it stealthily when the homeowner is home.

    Just my opinion, but even the airport security puts a note in your suitcase saying 'hey, we were in here'!

    When airport security searches your luggage, you have an expectation that this can occur. Same thing here, according to the HOA governering documents which everyone has a copy of, there is an expectation that HOA personnel can enter your property to verify possible violations. If you would like them to leave a note on the resident's door saying "Hey! We were on your property.", that could be something up for discussion, but I honestly don't see the advantage of doing this.

    The vests clearly state "Broadlands HOA Covenants Inspector" on the back. Isn't that clear enough? In regards to the comment about mistaking the HOA for joggers, I personally think that's surely a stretch. Your comment about doing it 'stealthily' doesn't have many legs to stand on. They are wearing brightly colored vests, properly labled and your neighbor easily spotted them, which was the point. How is that 'stealthy'??

    Finally, I personally do NOT want the individuals who go visit properties to go around ringing doorbells. There have been situations where they have been yelled at, threatened and even bitten by a dog. They are usually in and out within a few minutes. Having to ring doorbells and spend 10-15 minutes 'explaining' to a resident what they are doing there would make the whole process extremely tedious, not to mention put our employees at risk, something I do NOT want them to have to go through.

    This all certainly sounds reasonable enough to me. I am all for NOT adding additional layers of expense and bureaucracy. Seems redundant for them to leave a note when you'll be notified if you have any violations anyway. And it is probably safer from a legal standpoint to just notify residents in writing only rather than talking about it in person. If you just follow the rules and avoid having any violations then this whole conversation is moot. As for neighbors, I would just keep reporting them every couple of weeks until the problem is resolved.

    They have been wearing the vests since last December so perhaps they were not the Covenant Inspectors.

    Like I said earlier, I could care less who is inspecting my property. Main point is if you’re going to go to all the trouble and taking the time to mail out the notices, take pictures, then enforce it. My neighbor has been getting away with it for years. I had my son go over there about a week ago and talk to his sons and ask them how they feel about having the worst yard in the neighborhood. A week later they final cut back their bushes and mulched; now if I can somehow get to them to mow the grass I won’t feel like I bought in the ghetto.

    Did you report them to the HOA? If you did, then just let the process take it over from here. If you didn't contact the HOA offices, I would suggest you do so now in order to get your concerns addressed.

    Did this occur recently or prior to December 2009? As Maureen stated, the Covenants Inspectors have been wearing those vests since December 2009 for the very reasons you stated.

    If this is the home by the water tower, that was me, and you've got some facts wrong.
    As part of the HOA Board's review of picket fence guidelines, I was going around measuring the spacing between pickets. Spent about 30 seconds to a minute at each property and NEVER went around back. Went to about 50 homes in all.
    I don't consider walking up to the side of a house for a few seconds in broad daylight to be "stealthy". But feel free to call the Sheriff's Office on me if you are at all concerned.

    Why in the world would you want to measure pickets in a fence?

    My last neighborhood didn't even waste their breath and time doing that. As long the fence looked good in their eyes and did not look trashy and was in good condition was all they needed. Just sayin' too!

    That was exactly the point. Our guidelines use to say that picket spacing had to be between 3 and 4 inches. Earlier this year it was brought to the boards attention that many fences in the community did not meet our own guidelines. This left us with 2 real choices - make everyone comply or change the guidelines. Since the logical answer was to change the guidelines we wanted to make sure that if it looks good it was good but we need to set some min and max standards. Thus Cliff and I spent several days measuring over 150 fences around the community so in the future no one will need to carry a ruler :)

    Because there are specific design guidelines & the ARB/Modifications Subcomm (which Cliff and I both volunteer our time of nearly 5+ years) is in the process of revising/editing the design guidelines.

    So we needed to get an accurate sampling of existing fences.

    I love this topic (HOA enforcement) opinion is equally divided who think the HOA does too much and the HOA doesn't do enough.

    I don’t want to debate, I want my neighbor to mow his grass :happygrin: if I ever see him out of his house I'm going to approach him and have a little neighborly discussion. I used to own a townhome and was the only one that had a mower in my row of houses; I would mow everyone’s front yard to help them out…and let them borrow the mower if they wanted to do the back. There is no way in hell that I am going to be that generous with the size of his yard knowing he has a mower…I saw it once… a long, long, time ago :pofl:

    Does the HOA has insurance for these inspectors for the damage they may cause while doing these inspections?

    Also, has a background check been done on ALL of the inspectors?
