Home on Ridgeway drive a MESS!!!

    How do I get my neighbor to clean up their house! I have spoken to the neighbor. I have called homeowners over and over. No one helps us! Our neighbors property is a huge mess! Please come look at it and call homeowners too! Corner of Ridgeway and Mapleton CT. Please help!!!

    Have you contacted the HOA and had them look at the issue? Also, if it's trash or refuse, Loudoun County sanitation would be the place to call to. Good luck

    Yes! We have contacted homeowners. They are useless! I have called them at least 20 times!! They basically say there is nothing they can do because its not the front yard. But it is the front yard also. There are bags of mulch, garden tools, wheel barrows, shovels, rotted shrubs, old flower pots weeds as high as my fence. The property is a mess and unkept!! The owner should be fined by homeowners. It really is a bad situation and makes the neighborhood look like crap!! Not to mention the fact that god only knows what lives under the deck besides Duron paint (not safe). Please come by and take a look and report it to homeowners, we need help!!

    When you say you called the homeowners 20 times, do you mean the HOA? Is the lawn in a state of flux due to landscaping perhaps?

    You could help them clean it up. Maybe there is something going on in their lives that is difficult.

    Take pictures to document the mess and send it to the HOA.

    There is nothing going on in their lives. They just have no repect for rules and refuse to follow the HOA rules. They basically don't care about the HOA rules. Thats probably because everytime I call HOA all they do is send them a letter (so they say) and never enforce that they clean up! They have so much stuff going on in their yard it looks like a carnival. It's really a shame that we pay HOA dues and they won't help!

    So softballchick lets get something straight I don't live like a pig so therefore I don't help them clean up. Maybe you should!

    Villager we are going to try your suggestion. HOA tells us that they take pictures and since its mostly in the backyard they can't do anything. But it's a mess in the fronat yard as well. So maybe if we take our own pics and bring them there they might do their jobs and help! Thanks!!

    Jersey-Mom, sounds like at this point you need to take this situation up directly with the HOA. Kicking and screaming here on the forums won't help solve your issue, since you have already said that they are not responding to complaints from their neighbors.

    Contact the HOA offices and let them handle the issue please. Thanks.

    Mr. Linux have you read my posts! We have contacted HOA WES, Maureen several times!!! They do nothing!! All they do is let our neighbor continue to do what they want! There are dead shrubs in their yard from Van Metre that are 6 years old that I have begged WES to have cleaned up. Nothing has been done!! So don't talk to me about kicking and screaming!! THE HOA DOES NOT DO THEIR JOB!!!! Maybe all of you who let them get away with this should come be their neighbor and then lets see if things change!!

    Yesterday I contacted the family who lost their cat over a month ago to let them know it was under the deck of this un-kept home! They came immediatly to rescue their cat Sunflower. When they arrived and saw the conditions they where shocked!! They could not locate sunflower under the deck but did find a Kitten living under there. There is everything living under there!!!!

    Jersey-Mom, I understand your frustration, but what you see as 'inaction by the HOA' might simply be that the homeowner is ignoring the requests of the HOA, ignoring mounting fines etc. You have your side of the story and probably not all the facts. Trying to get your fellow neighbors to 'call the house', etc, won't help and might simply infuriate your neighbors and cause more issues.

    If you believe that the HOA staff is not addressing your issues, I urge you to take some pictures of the property (while respecting your neighbors property) and to come and talk to the HOA Board directly at our next meeting and discuss the situation directly with us.

    You have contacted the neighbors and they have not acted. You have contacted the HOA staff and you believe that your issues are not being addressed. The next step in the process is to come present those issues to the Board so we can review the situation and act accordingly.

    Getting a dozen Broadlands residents to call your neighbor isn't going to help things get better at this point, in my opinion. Please, go through the process we have in place to remedy these kinds of problems.

    Mr, Linux We do have all the facts!! The last time I spoke with Maureen she told me their is nothing I can do in those exact words!! She also told me that she walked the property and took her own pics and because its the side and back yard they can't help us. I also don't feel that I need to take time out of my life to come to a meeting to get the HOA to help us. It is their Job to help us!! We have living guidlines here in Broadlands and this family is obviously not following them and they need to act on it.

    If there is any truth in what you are saying about maybe the owner ignoring the HOA. Then my question to you is what would HOA'S next step be because the owner had been ignoring them now for about 4 years!!

    Mr. linux come a take your own look! If you do please don't do a ride by please get out and look along the fence line of the home and its neighbors. Walk aroung the home so you can see all the dead shrubs, all the bags of mulch empty and full. All the the empty pots from old shrubs, all the flats of dead seasonal flowers never planted. All the started and unfinished projects. All the wheel barrows filled with garbage. All the rakes, tools and shovels that are left out everyday. All the weeds along my fence that are 3 feet tall. Look under the deck at the gasoline thats left out there for the lawn mower, and all the cans of duron paint that sit under the deck day after day for 4 years!! Then please tell us that we don't have all the facts!

    Then I'll return the favor. I don't feel *I* need to take time out of *my life* to resolve *your* issue since you are not willing to go through the process.

    When you're ready to talk to the HOA Board, we'll listen. Until then, have a nice summer.

    Wow....
    If a judge asks you to come to court to provide documentation to support your case as a plaintiff because a police officer has evidence contradicting your claim, do you rant at the judge and tell them you won't go to court because it's the judge's job to help you?

    You're trying to establish a case against your neighbor, you've asked the "local authorities" to step in, they reviewed the situation and don't believe they can, and now you're taking it to the judges... but you're asking the judges to do the work of preparing your case for you?

    At any rate, if you have you Homeowner's Declarations then section 7.2 is what would seem to apply here. You can look that up to see what the HOA's options are, between this and whatever state law allows HOAs to do to enforce their rules. According to 7.2 the HOA sends a letter recommending action to rectify the situation, and if remedy isn't made within the specified timeframe the HOA may take such action on behalf of and at the expense fo the owner, subject to certain guidelines specified int he docs and in state law. There may be something in state law preventing the HOA from encroaching on the property of the neighbor to remedy the action (since sections 5.3 and 11.1 allow the HOA and designees access to the grounds but not the dwelling in order to carry out its duties...), in which case all they can do is levy fines, which could be ignored. Ignore long enough and I believe the HOA can lien the property for the fines but that's not a quick process. I'd guess several months to a year or more to get to that point.... Just a guess....

    Plus all games are off if the property goes into foreclosure....

    Please also remember the HOA board are not paid employees, they are volunteers. Mr. Linux will indeed be working through the summer, I'm sure.

    whether their paid or volunteer don't take the job if you don't want to perform the duties required.

    This has been going on for years! We go from one issue to another with this neighbor. The house is so far gone, why do we need to go to court? Anyone in their right mind can glance at the property and see it needs to be cleaned up. When I say anyone I mean anyone. Yesterday a ball landed in the yard. One of the neighborhood kids went to get it and tripped on a large metal can and said boy they need to clean up.

    So when I call HOA and they ride over to take a look- what is it that they can't see? What is it that I need to bring pictures of? Why do I need to bring pictures when they have already seen it first handed for themselves. They have to be blind to not consider this an issue. It is so obvious why do we need to take pics and go fight for what is not allowed in Broadlands.
