The HOA has been receiving complaints about cars parked illegally in the community. It is primarily occurring on private streets with fire lanes (that have signs, painted yellow curbs, and "no parking" painted on the curbs).

The HOA is considering contracting with a towing company to start towing illegaly parked cars.
    What do you think?

We have to pay? I would think the towing company would have it's own incentive to be allowed to tow ? :)

Only the person who is towed would have to pay to get their car back. The contract would be to spell out exactly who the HOA wants towed and under what circumstances. Ie a phone call from the HOA for a repeat offender vs the tow company driving around and towing a 1 time 30 second offender.
With some of the tow companies they will even pay the HOA to be allowed to tow from HOA property *** NOTE**** HOA is not looking at this to generate money just to inforce Fire Lanes and illegal parking. If everyone parked leagally then this would not have even been considered.

the last line is what I was after.. I was surprised by cliff's comment of 'paying someone..'. I thought at the least they'd be happy to come tow someone to be able to collect their fees from the offender to get their car back.

But presumably they wouldn't come on demand - heck, they barely show up when you call AAA :)

If cars are regularly parked illegally, especially in areas marked no parking, then absolutely they should be towed. I think Staci's example is perfect. The repeat offender vs the 1 time 30 second offender. Fire lanes are fire lanes for a reason!!!

Would there have to be signage saturating the community with if towed, call ....?

Yes there would be signage associated with implementing any towing. And hopefully this is something that HOA can get the tow company to pay for as well as post for us (again the reason for a contract)

    Steve-
Reread what I wrote....I did NOT say "paying someone", I said "contracting with".
I'm assuming you assumed that meant paying someone. It does not.

We could put the towing companies contact info in the Newsletter.

How about if people are illegally parked, the police enforce the laws?

I have been trying for years to get the sheriff's dept to enforce the Fire lane and illegal parking but since most of these are HOA owned private streets they have no interest. Plus I have been told multiple times they do not have the staff to deal with illegally parked cars. The cars are still parked illegally so the HOA is looking for a way to enforce it - any other ideas how we can besides having them towed?

Why not have the fire company come and do some drills on that street. I know they love to smash car windows and run their hoses through them !!!

i don't think there is any other answer. PAIN is the key to change!

it'd be nice if it happened just to habitual offenders, not a first timer for 30 seconds as someone said earlier. if there was a way to issue a 1 time warning, track the plates, then when it's a 2nd offense or more then they get towed, that'd be optimal. sounds like a paid position that needs to be added to the Broadlands payroll! :)

I did assume because 'contracting' typically means 'hiring'. Considering the price sensitivity of everything we add into the HOA scope, one would assume 'whats this going to cost us' is part of the discussion. Being clear on that to start with would help in the solicitation of input :)

Illegal cars parked on private streets that are clearly marked should most definitely be prime target for a tow truck! It will never cease to amaze me that there are people in this world that blatantly turn their nose to rules/regulations that can potentially cause harm to other law abiding citizens. Someone parking in a fire lane could block a fire truck that is en route to save a citizen… If Broadlands enlisted the services of a tow truck company, it would be a great thing!

I agree w/ HappyinVA... I also think it could prevent possible altercations between homeowners if the cars are being towed under a contract w. the HOA vs. an individual calling and requesting.
