A few comments....
The Developer does not hold any deeds to common area that is off bond and turned over to the HOA. Easements can be added at any time. I know because I've signed off on some.
I agree it is highly unlikely that any provider, whether it is cable or Verizon, would come in unless the Openband contract was terminated.
Given that I know Eric quite well, and you don't know him at all, I hope most readers would give him the benefit of the doubt.

Unfortunately, I think the end result of the Openband drama will be a higher authority stepping in and mandating a change - whether it is the government or a court of law.

The good news is that the FCC is currently looking these types of exclusive contracts and in a year or two; there may be a ruling that invalidates the Openband contract. See this recent FCC News Release: http://hraunfoss.fcc.gov/edocs_publi...C-271706A1.pdf

I also find it interesting that other local HOAs (River Creek, Belmont CC & Brambleton) have recently dissolved or amended the agreements they had with their Video/Phone/Internet providers or they have sold out to one of the "big" providers:

River Creek – Residents can opt-out of the (previously mandated) cable service from Adelphia (now Cox)
Belmont Country Club – Community Cable/Internet service was bought out by Cox
Brambleton - Community Cable/Internet service was bought out by Verizon

Based upon these boards only, I agree - Eric is a great guy, and extremely dedicated. But my initial reaction of his post was like reading a slap in the face. Intentional or not, an informed person on this board and with the SWHOA Openband stuff would have known that Ken was "appointed". I would have placed Eric into this category too, which is why I think my initial thought was that he was trying to imply something without saying it.

BUT - I think Eric has put it to rest and we should let sleeping dogs lay... and not let another issue run a muck... (myself especially).

And db103 or others - do we have copies or links to these other stories? Seems like a great place for research...

Steve - do you know contacts in these communities? I think this has merit to look into further as it really directly relatedsto our situation. Lessons learned would go along way now toward helping us understand possible outcomes. Anyway, I was also talking to Ken not too long ago about that "what if" scenario of another carrier. I was worried, what if OBB walks away?

I'm an outside observer to this mess (though I did live with Openband in Broadlands South until 2005), but it seems to me that since KnKCorson and the other member were appointed to a board position that has traditionally been a homeowner-elected position (and is it supposed to be an elected position?), it is only right for those appointed members to introduce themselves to the community and explain their views towards VM/Openband, their contacts/relationship to VM/Openband, and any other relevant information that they would disclose in an election.

I know that if I were still a homeowner in Broadlands South and two normally-elected "resident" reps were thrust upon me by Van Metre/Openband and were going to be representing my interests on the board, I would want to know more about their views and how they intended to represent my interests.

But that's just me.

Welcome to volunteer service!!

Flynnibus-
To sum it up in a nutshell. SW HOA resident reps have previously been elected by the residents. The two reps that were on the Board resigned.
A call was put out for volunteers interested in serving on the Board.
Per their Articles of Incorporation, this appointment would last until the next Annual Meeting (this month) where new reps SHALL be elected.
I believe 5 people put their names in and were eventually interviewed.
Van Metre cancelled several months worth of meetings and delayed appointing the resident reps until last month.
Because some of the Van Metre SW HOA reps do not like some of the people who volunteered and did not want to risk these people being elected in May, they chose to violate their own HOA Articles of Incorporation and APPOINT two resident reps for 3 year terms.
Ken was selected as well as another gentleman who has since declined the appointment.
This process Van Metre used led to outraged residents who then wondered about who these two were that were appointed. Van Metre's unfortunately creating problems among the residents.

ALL Broadlands residents should be aware that Van Metre may try to pull this same trick at our meeting next month because one of the people they wanted to keep off the SW HOA Board is runing for the Broadlands HOA Board. If they try it they will learn the meaning of "Hell hath no fury like an HOA President scorned."

Have I told the HOA President lately (in the words of Farris Buller) "you're my hero"? Gee... I wondering who that "one person" Van Metre targeted for the SW HOA and now may target for the BHOA position...is this person fondly known as the pittbull?

Curious.. was this through the newsletter or some other means?

Thanks for addressing the question Cliff.

I know the board didn't recognize why they selected whomever from the volunteers.. but I am amazed the appointees haven't even offered up why they volunteered in the first place. I just want to hear why they are motivated or interested. It just a personality type question.. not an inquisition
