In addition to mailing the monthly newsletter, the HOA does post the newsletter online (http://www.broadlandshoa.org/node/24). Furthermore, this forum had multiple discussions about the towing rules prior to the rules being adopted by the HOA.

Sunny, it can and does get bad in the townhome sections from time to time. And the streets on our side of SW are much more narrow than yours.

Whoa! You are going a bit off tangent here...You are drifting into nonsense here.

After reading numerous postings of yours, I want to make some observations here:

    1) No one asked you to discuss your four kids and your many jobs to make ends meet. That was your decision and that has NOTHING to do with your illegal parking. Your comments about kids playing between midnight and 4 AM is really a bit farfetched and silly IMHO.

    2) It is really your obligation to read the Community magazine to keep abreast of what is going on in the Broadlands community. Even though I am extremely busy as well, I always make some time to read the magazine as I want to know what is going on around me.

    3) If you don't like the community's rules and regulations, then by all means move to a community that doesn't have a HOA, which is becoming a fading dream because many communities want to have HOAs to keep property values from declining.

    4) Parking enforcement is a given in many neighborhoods nowadays. If the HOA didn't enforce the parking issue, the county will do it. County police WILL tow your car. It doesn't matter WHO is doing the towing...the point is, if you broke the ordinance, then you have to suffer the conseqences.

    5) Belitting other members on this forum with your snarky comments isn't going to help you any nor will it help the board members from helping you out.

    6) They have offered to help you out by asking you for your street address (by the way of Private Message) and you haven't done them a favor by giving them your address so they can see if the towing company was a bit aggressive or not. You chose not to. So its your loss. So quit your harping on it if you think nothing of throwing away $150 bucks. But if its a big deal to you, then help them help you by giving them your address. Simple as that.

    7) If you really are that angry with Broadlands over a little itty bitty parking issue and that issue only is causing you to want to move away from Broadlands, you've got some issues, buddy. THis community is a fantastic one and my family and I are extremely happy that we moved here from Fairfax County. We can feel the warmth and closeness of this community so far. People here are great and the community rules and regulations are not that restrictive as we see it. The parking rules and regulations are set in stone for a PURPOSE-to avoid illegal parking and for CHILDREN's safety. If you cannot see that or understand that, then you've got a problem that we cannot solve for you.

    8) Have a good evening and make sure you read the next issue of Broadlands Magazine!! Its certainly not junk mail to me and I enjoy reading it!!!

One more thing, I'd like to add here is your assertion that you "lost more than that in business because of the delay I have ot wait to get my car." Whose fault is that? Surely NOT the board or the association. They didn't cause you to lose money. So why bring that up? To me, when you brought that point up, it sounded like you wanted to blame someone else for the loss of business revenues. If that happened to me, I wouldn't even bother bringing that point up because its really not their fault whatsoever. Geez--- This ranting/venting is really pointless to me.

Let's see the picture. Post it. That will tell us if the guidelines were followed, or not. I want to know if they weren't for some reason.

The objective is not to make homeowners upset or unhappy about their neighborhood. the main objective is to maintain a beautiful neighborhood with happy homeowners living in it. Yes, there may be some people that are always breaking rules and making other people's life difficult, we should help them obey the rules. If HOA wants to get in the business of enforcing county rules that another matter we should discuss.

The HOA is enforcing the same rules the County does, but ONLY on HOA owned streets, such as yours. The County has no authority to tow on HOA owned streets, which is why we imposed the rule. On County streets, the County has towing authority. On HOA owned streets, the HOA has towing authority.

The HOA is NOT enforcing County rules on County owned streets.

It's evident that you have not read any of the information that was posted in the newsletters over the past few months. I would suggest you go back and read the announcements before making blind statements here on the forums.

I'm at a loss at this point as to what you are trying to accomplish with your posts. Members of the HOA have responded to you multiple times offering to help and you have turned us down. What exactly do you want at this point?

Sunny, I'm actually glad you feel that way. That means there are no issues on your street. For others, where issues do exist, the contract is a wonderful thing.

MyCrosswind26, for someone 'too busy to read the newsletter and HOA communications', you sure have a lot of time to spend on the forums. Might I suggest you take some of your forum time and apply it to reading HOA communications sent to your home?

I do agree, it is not their fault, I take full responsibility for my mistake. It is my fault I parked illegally and I violated county's rule. I am not blaming the board or towing company. I am trying to make a point to the board members that towing cars at night for violating non-emergency matter is an extreme punishment. I respect all rules including HOA/county/Fed/God rules. I learned my lesson and I express my opinion about this matter. it is up to them to act. either way I will support and follow whatever decision they make.

We have already made our decision and implemented the rule a few months ago. You are free to voice your opinion directly to the Board at our next meeting, July 13th at 6pm in the Nature Center Conference Room. The Board and I look forward to hearing from you in person regarding your issues with the towing guidelines.

    Thank you.

What time of day would be better? It seems overnight is the best time to tow because it is clear the car has been left blocking the sidewalk. If they towed in the afternoon someone could make the argument they were parked there for only a few minutes to bring the groceries in, etc. When a car is blocking the sidewalk at 4am, it is obvious the car has been parked there for hours, not just a quick stop. Besides, when kids get up to go to school in the morning, the sidewalks should be clear. 4am is a pretty good time to remove any illegally parked cars to clear a walkway for the morning commute/school day.

In addition to the newsletter there are also towing signs posted throughout the neighborhood. They were put up well before enforcement started.

I'm sorry if I missed it, but can anyone point me to the terms of the contract? How much does the security company, towing company, and HOA get out of each $150 ticket?

    Security company: $0
    HOA: $0
    Towing company: $150

The towing is only permitted to tow cars under 2 specific conditions: cars parked in fire lanes and cars blocking sidewalks. Digital pictures are taken of the vehicle in violation prior to each tow and put on file. The HOA can request copies of images for any tow. Since the towing rule has been put into place, I am not aware of any tow that was not justified. A few residents have contacted the Board in the past to complain about a towed vehicle, but when the images were reviewed, in all cases the vehicle clearly blocked the sidewalk completely.

Basic terms of the contract: Battlefield has a right to tow any vehicle on a HOA maintained street that is parked in such a way that it fully blocks the sidewalk and thus impedes the natural flow of pedestrian traffic or any vehicle that is parked in the fire lane.
Battlefield is responsible for providing a towing slip as well as visual evidence (if requested) of said violation to the HOA office.

    HOA gets $0
    Security Company gets $0
Towing Company gets $150 that is their fee.
**as a note they did make and install all the towing signs that were put up around the community so again no cost to the association **

LCSO enforces the same rules on the VDOT streets.
