Car Towed Out of Driveway

    My van was towed out of my driveway last night by Battlefield towing. They claim the vehicle was blocking the sidewalk. Has anyone else had this happen and do I have an recourse? I have lived here for almost 10 years and never had any issues.

    I recall reading in one of the monthly newsletters that the HOA towing guidelines permit towing of vehicles blocking a sidewalk. I doubt you have any recourse.

    They have smartphones now and can take pics of the alleged infraction before towing people. That's what they do nowadays to protect themselves. They do the same here at my company's parking lot-

    Wow! At its face value that seems really excessive. In light of this I am really concerned about what is going to happen when the green algae shows up on the North side of my house this spring... Will the HOA sponsor a Napalm strike?

    It's been a long recurring complaint... I don't know if there is a new effort to enforce the rules or not. But very common in the townhome areas where people complain about not being able to use the sidewalks due to vehicles blocking sidewalks.

    Odds are it was a neighbor who complained. I highly doubt the HOA patrols for this type of infraction.

    I did see a car driving around slowly today with a Broadlands sign on the side. Looked like a Prius. Does the hoa have cars for patrolling?

    Question for the Original poster, was your van blocking the walkway? ...or was any part of your van in the walkway?

    Its not excessive if you need a wheelchair to get around. The sidewalks are not a nice to have when you need them to be mobile within the neighborhood.

    The HOA does have a car for official use but they do not "patrol". One use is for Covenant inspectors use it to inspect homes for compliance with applications or lack thereof.

    This is not an HOA violation. It is a law. I hate to sound unsympathetic, but your van wasn't towed from your driveway, it was towed from the sidewalk, which is public property.

    I can see both sides of this issue, and admit getting personally frustrated when some unthinking resident blocks the public sidewalk with their vehicle requiring me to walk out into, what is at times, a very busy street. The thought of school age kids trying to use our sidewalks but being forced out into the street by this easily avoidable activity by vehicle owners is enough to raise one's blood pressure. That being said, it would seem reasonable to give every resident one written warning before authorizing towing a resident's vehicle, blocking a sidewalk,from their driveway. The address of the residents receiving a written notice could be sent to the towing company for their records and any vehicle at that residence could be green lighted for future enforcement. This way, the only ones affected by this towing policy are the negligent, uncaring residents rather than the merely unaware ( I would like to think most of the violators fall into the unaware category). This slightly revised policy would seem more fair, neighborly and less "Gotcha!" Alternatively, our towing policy could remain intact as it is but a written warning about this parking/towing policy, and why its needed, could be included in the monthly Broadlands newsletter...

    Who issues the warning? The HOA is not staffed 24x7 nor do they patrol for this infraction. When first started, the towing company would make a few rounds but business was not "good" enough to justify that practice. I am willing to wager that it is almost entirely neighbors who call in illegally parked vehicles.

    FWIW, I will not hesitate to call the towing company if a car parks on the fire-lane side of our narrow courtyard home street.

    I can't tell you the number of times I see cars in Broadlands parked over a sidewalk. As a walker with my dog, it's very inconsiderate as we have to go out into the street to go around the vehicle.

    I live in SW and walk my dog every day. It it is rare that I encounter this situation in my section of the community, but I agree it is extremely inconsiderate.
