HOA considering restrictions on home-based businesses? (merged)

    I believe that the Virginia and/or Loudoun regulations state that a daycare provider can have a maximum of 10 children with 2 caregivers at an in home facility. If an HOA wants to have different guidelines for their community they are allowed to do so. However, from my experience that can be difficult for a provider if they have budgeted for more children and therefore more income.

    From my experience with this issue in Lansdowne, I hope that the HOA does not have to become involved with regulating home businesses as a whole but can find a way to resolve issues on a case-by-case basis. The in-home preschool my child attends is and always has been fully licensed and operates with the cooperation of the neighbors (although apparently not the current HOA board). It seems to me that if a home business operator wants to take their business seriously they should do everything they can to make sure their work is licensed and has minimum inconvenience to the neighbors. That's just being professional.

    P.S. - the school owner should also be capable of advertising their school without having misspellings and incorrect grammar if they want to educate my child at any level. I'm just saying...

    Or purchased a home with the additional traffic and parking in mind.

    my mother has run a successful home daycare in Nebraska for over 10 years now, and she has specific drop off and pick times for each parent so she doesn't have 6 cars showing up at once. maybe if Ms. Baker gives them specific windows of 5-10 minutes, it will ease the APPEARANCE of trafffic, AND it is actually a better transition in and out of care for the families! hmmm!

    redon1...what an excellent solution! Maybe it's not practical for the parents or vice versa but someone should make concessions or at least give it a try.

    youd' be surprised what a parent will do to keep their spot at a daycare they love. i talked with my mom about it, and she explains to parents that out of consideration for neighbors, AND so they have her full attention and aren't waiting to talk to her about their babies and any passdown info, it's vital that they arrive and pick up within their window. the parents have a hand in choosing their window so it works with their schedules. she says THEY appreciate it b/c they can get out a little earlier, get coffee b4 work, AND they like having her full attention on the turnover... she has never had to fine or reprimand ANY parents for arriving outside of their times, and says it works GREAT.

    Think about giving it a try Mrs. Baker- it might be a win-win for everybody!!!

    The idea of specific drop off and pick times for each parent seems resonable and gan verall good idea but we still want a limit on the number of children.

    there ARE regulations on the number of children allowed based on sq ftg and number of teachers- that's what the limit should be based on.

    And the folks on Fern Brook Court believe the HOA should impose additional restrictions based on all the concerns that were brought to their attention as the last meeting.

    since i am not directly affected, it's definitely beyond anything else i can add to this thread, so i will simply wish you all a happy resolution that satifies all parties! :)

    According to the Little Sprouts website, the school currently offers classes Monday-Thursday from 9am-12:30pm. Also available is a Mom's Morning Out on Mondays, Wednesdays and Fridays from 9am-12pm.

    For the summer they have available: Tuesdays and Thursdays 10-1pm, Wednesdays 9-12, and Fridays 10-1.

    In the fall of 2009 another class is tentatively scheduled for Monday-Thursday 12-3pm.

    I believe that Virginia and/or Loudoun allow 10 children per two teachers. It sounds like a busy place - a staggered drop-off and pick-up would be a good idea.

    you could be directly affected if the hoa decides that the squeaky wheel deserves a change in the rules. if you only defend your freedom when it directly affects you, you may be sorry that you gave up those rights later on.

    I was going to say the same thing. You may not be affected now, but you may be in the future. Technically this isn't really just about the people who live on that street.

    i only meant that i didn't want to get into a big argument about it here since i really can't KNOW what their issues are with the school.

    i can sit HERE and say i'm in favor of the HOA staying out of it and following county rules, but i don't know what Mr. Fan is going thru. is it really THAT bad? are more neighbors bothered, or most don't care and only a few are speaking up?

    if it ever came to a vote by residents, i would have to know more about the actual impact it is having on the surrounding neighbors, and i don't think the few ppl speaking about it here is a fair representation of EVERYONE who is directly effected in this case. i would be 100% involved in voting or expressing an opinion based on the FACTS, not several disgruntled ppl on a msg board. after all, how many MORE neighbors don't come here to discuss it, don't mind it, or DO mind but don't say anything?

    and i stand by my statement that in THIS case, no one who is not directly effected by this daycare can know the issues (or lack thereof)it causes its neighbors.

    yup. ppl forget what a fishbowl this forum is in an ocean of residents. i want facts before i judged: someone would need to sit and watch the drop off pick up, how long does it go on, how many cars is it, during the day are the children playing in an unprotected, area- ie, the culdesac rather than a fenced in yard, is there excess noise, etc.

    Not wanting the traffic because kids play on the street is a lame excuse. Yes. A cul de sac is still a street.

    Well if she staggers all of the parents she is allowed to have (i.e. 10) then the 12:30 end of class wont happen because everyone will come staggered. meaning one at 12:30 one at 12:45 etc etc. Because if not then you still have parents waiting in the cul de sac trying to get in and out until all 10 are picked up..( If that makes sense)

    there are no easy answers or fast solutions here, just brainstorming suggestions until the answer appears...
