    And now a word to the little criminals running around out there - yes we know you troll the site looking for reactions to your handy work. If you think you won't get caught, ask the BB Gun Bandits from last year. A CD with footage from a surveillence camera passed to the Sherriff's department landed three little buggers in hot water and their parent's were stuck with a bill to replace windows. No trial or jury needed.

    Getting caught can have some interesting, long term effects. Think you're going to be on that varsity team? Probably not. Have your sights set on that ultimate "Party College"? Yeah - not with a GED gained from the JCS.

    Oh, and just because you don't see a security camera, doesn't mean there isn't one.

    We have a Neighborhood watch program - but it has ZERO participation (besides the email list). Even had a national night out Aug 3rd and NO ONE showed up. I had been hosting quarterly meetings with the LCSO and my big meeting had 5 people show up - the last few meetings the only people in attendance was me and VaCliff. One thing I need to get residents to understand is NW is not about having groups of residents patrolling it is about everyone paying attention to their surroundings and their children and reporting things that do not seem normal. No matter how small they may seem. The more reports the more deputies here the less likely of vandalism etc. I am trying to schedule 1 more NW meeting this year yet, but if I get no participation except the few times a year something happens to 1 family it is just too much work for me to keep running.

    I would participate, but as a single parent w/ 2 kids, it's difficult to make it to meetings. But if you send out materials telling me what to do, I'll do my part.

    I think in Ashburn Farm they can suspend priviledges of families whose children are found to destroy property. No access to the pools, etc. Not sure how effective it is but it could be added to the arsenal.

    On a side note, doesn't Costco sell some relatively inexpensive surveillance equipment?

    I send out information in almost every newsletter under the NW corner. There is nothing coming in the Sept issue as I was out of town at the time of the deadline but almost every month I have different tips and what to do.

    Yep, that's where I got mine. Was not impressed by what they had at the store with the included monitor so bought a Lorex online from them. Some others in Broadlands have Lorex also.

    It is a low-midrange solution in the great scheme of things, you can pay $800 for a megapixel ip camera which takes amazing pics. Kim thinks that is perhaps a tad extravagant so the idea is on hold at the moment, given that we've not had any problems I tend to agree.

    Having said that the pics on mine are better than what I saw at the gas station nearby, and better than those poor quality pics of the subway robber.

    Right now they have a system on sale that is 8 cameras for $700. I personally like a little more range on the cameras, that one I think has the 3.6mm lens which is pretty wide angle. I opted for the 6mm which gets a better pic. You could also augment them with one or two really good cameras, there are a couple of good online forums with recommendations. I think they also have a 4 camera system on sale for $400. Some of the more expensive systems can record at higher resolutions, i.e. you tend lose a little bit of quality in the DVR. Anyway, they have a pretty good return policy.

    Now if we could just figure out what is eating the blueberries...

    I do not believe the HOA has any such authority. I would love to see some case law, in Virginia, that allowed it.

    From Code of Virginia:

    § 15.2-926. Prohibiting loitering; frequenting amusements and curfew for minors; penalty.

    A. Any locality may by ordinance prohibit loitering in, upon or around any public place, whether on public or private property. Any locality may by ordinance also prohibit minors who are not attended by their parents from frequenting or being in public places, whether on public or private property, at such times, between 10:00 p.m. and 6:00 a.m., as the governing body deems proper.

    A violation of such ordinances by a minor shall be disposed of as provided in §§ 16.1-278.4 and 16.1-278.5.

    B. A locality may by ordinance regulate the frequenting, playing in or loitering in public places of amusement by minors, and may prescribe punishment for violations of such ordinances not to exceed that prescribed for a Class 3 misdemeanor.

    C. Without limiting or restricting the general powers created by this section, the term "public place" shall also include public libraries.

    Could HOA be defined as a "locality" in this case?

    Agreed we need surveillance cameras on all street corners, officers checking ID's plus immigration status, peanut butter in pockets, etc.

    CHAPTER 481
    An Act to amend and reenact § 15.2-926 of the Code of Virginia, relating to powers of local governments; loitering on grounds of public libraries.

    Be it enacted by the General Assembly of Virginia:
    1. That § 15.2-926 of the Code of Virginia is amended and reenacted as follows:
    § 15.2-926. Prohibiting loitering; frequenting amusements and curfew for minors; penalty.
    A. Any locality may by ordinance prohibit loitering in, upon or around any public place, whether on public or private property.     2. That this act is declarative of existing law.

    § 1-221. Locality.
    "Locality" means a county, city, or town as the context may require.

    §1-254. Town.
    "Town" means any existing town or an incorporated community within one or more counties which became a town before noon, July 1, 1971, as provided by law or which has within defined boundaries a population of 1,000 or more and which has become a town as provided by law.

    Unless I read things incorrectly, Broadlands is an incorporated community which has, within its defined boundaries, way more than 1,000 folks.

    In searching other HOA articles, bylaws & such I found six which impose a curfew, some based on the school year. Of these I searched the laws governing HOAs in two states; North Carolina & Washington (just at random - no real logic). In neither case was the power to impose a curfew either specifically granted or denied.

    As stated before - I am no real fan of trying to make our HOA less transparent than it is - most of us like it that way. However, it is rediculous to try and deny that there is a vandalism problem in the community. Will it go away next week? More than likely, but the problem will return next summer or even between now and the cold weather on the weekends.

    Therefore, I think it's time this community seriously consider a well publicised curfew be imposed.

    Kaos, I don't think we fit the definition of a 'town'. Reading the extract above it says "an incorporated community within one or more counties which became a town before noon, July 1, 1971". We never became a 'town', we're still a community. Becoming a 'town' is a whole other can of worms. We would in essence have to become something like the Town of Leesburg (http://www.leesburgva.gov/) within Loudoun County or the Town of Vienna, within Fairfax County (http://www.ci.vienna.va.us/). We would have our own government, police force, taxes, water authority, etc.

    I don't think many Broadlanders are interested in becoming our own entity within Loudoun County, like Leesburg or Vienna. Well, I never asked around, so this is an assumption :)

    At least that's how I read your extract above... I could be wrong... But the way I read it, we don't have the powers to impose a curfew...

    But, it's not an extract. Those are the sections in full & the most recent versions.

    The fact is we are an Incorporated Community (yes?) with a population in excess of 1,000 (yes!!!) - as I read the above, we qualify as a "town" - quotes inteded to stay. Personally, I think we send up the balloon and see who shoots at it.

    We are not an incorporated community - which means a municipality, such as town, borough, township, or city. These are setup by a charter by the state.

    We simply have a HOA binding home owners to certain policies.

    You don't 'qualify' as a town - you are incorporated by a charter or similar by the state.

    The existence of a HOA under state law does not qualify as a incorporated municipality.
