HOA Late Fees

    So, it appears that starting with the December bill, the BHOA Assessment went up by $4.25. To we are late in December and January to the tune of $8.50.

    HOWEVER, they have added late charges of $25/Month + a Reminder Fee of $5.46 so after two months of underpaying by $4.25/month we "owe" them $70.42?

    1) What business is the HOA in? Providing services for dues, right? And it is a service business, right? I cannot fathom how this is considered customer service. Phone call? Email? We pay by automatic debit, and they are aware.
    2) What would YOU do if you were in my shoes? Pay the late fees? Fight my late fees? Or report them to the Commonwealth and FTC for the violation of FDCPA Laws?

    I thought the BHOA fees were staying the same for this year? I didn't pay more in December or January than I had prior nor do I remember getting any notification of change so I imagine I'll see similar fees. This is the BHOA fee right and not So Walk?

    I just found the coupon book that was mailed to me for 2014 and the amount is no different for me for 2014 compared to 2013. This is the BHOA fee for a townhouse in the North.

    BHOA fee is the same as last year....i looked at the coupon booklet and its the same as last year....no change.

    Give the HOA Business Manager a call on Monday to determine where the error or misunderstanding is so that it can be resolved before escalating to the Commonwealth and the FTC. Just as you said in #1, a phone call or email seems appropriate.

    1) The HOA incurs costs when residents don't pay their dues on time and in the correct amount. First Service manages the finances for the HOA and when residents don't pay or don't pay correctly there are charges the HOA incurs.. The letter you received costs money to send and is required by the law and the HOA (meaning the other residents) shouldn't have to pick up that cost - thus the reason you were charged. Also late fees are standard practice in the HOA business and any other business - if you dont pay your credit card bill they charge you a fee as well. The law requires a certain process be followed to protect both residents and the HOA and thus there are no phone calls,etc..

    2) You should contact First Service to see what the issue is and then if you're not satisfied contact the HOA office. First Service can give you all the details and if there is something wrong correct it for you - problem solved. If the charges are valid then you can make a request to the HOA Board to have your fees waived/reduced.

    And the fees change on January 1, not December 1, (and as noted there were no increases this year) so I wonder did you change you auto payment in 2013? If not after you hit a certain dollar amount then thats when First Service would start the notification process.
