Southern Walk HOA charged me $1,506.88 in “legal” fees for daring to ask to see the HOA docs

    Capricorn.. you are truly a pillar of the community. Can you please provide the lack of technology improvements via OB that you contest. Also, any backing references while you are at it. Perrhaps the Legal folks can take note of your claims and use as evidence in their losing cases..

    I never professed to be the pillar of the community but you certainly can do a comparision of OB and comcast, verizon FIOS, and Cox, DirectTV, etc and see which ones are far better in terms of technology.

    I encourage you to look at the numerous OB technology complaints various residents here have made on the Broadlands forum with respect to lack of technology evolution within OB. Im not the only one that can tell you that OB hasn't really upgraded their technology when comparing to other companies. Why do you think SWHOA sued OB to begin with? I suggest you look at the history of the lawsuit that is still in play. Landsdowne also sued OB (and won!)....

    I can only hope that OB brings their technology up to par in comparision with the other companies. Maybe then SWHOA will drop the lawsuits? I dunno.

    This may not actually qualify as a lack of technology, but rather it is a lack of service availability. OpenBand users are unable to access apps/websites such as WatchABC, WatchDisney, WatchESPN, etc. because OpenBand does not have license/carriage rights for access to the content streamed from these Disney/ESPN-owned sites.

    I have asked and opened ticket about watch ESPN going on I would say almost one year. Openband response they are "working on it"

    What else can we do as a community? To push this type of issues.

    "In upholding the Lansdowne HOA lawsuit, U.S. Judge J. Harvie Wilkinson III called the structure of OpenBand's exclusive agreements "convoluted."

    We signed a contract when we purchased our home..Now explain to all of us the technological shortfalls..

    Did you sign the contract knowing the full extent of the arrangement?
    That Openband, not you, not your community, not your HOA get to decide who your provider would be for the next 60+ years?
    That Openband, not you, not your community, not your HOA get to decide who can provide terrestrial service in your neighborhood?
    That Openband, not you, not your community, not your HOA get to decide what prices every home is required to pay, and for what services?
    That you, and your neighbors, must pay Openband for other delinquent homeowners?

    As for technological shortfalls... do you have enough time in the day?
    - Their phone line pricing model is from the 90s... not the 201x.. Loaded with per-line item charges that most companies bundle in for free
    - Where is your electronic integrated voicemail, mobile apps, etc
    - Why on earth are you still having to pay for landline services when everyone else has moved to basically giving it away
    - You are still paying pricing based on 3 services, and they refuse to acknowledge 'bundles' in their pricing comparison
    - Where are your mobile apps for DVR, TV Control, etc?
    - Where are your DVRs that can compete with Xfinity or FiOS quantum? Streaming, capacity, number of recorders, etc.
    - Where is your take my recorded content on the go solution?
    - Where is your HBOGo and other direct content provider value added offerings?
    - How is your ondemand library compared to Comcast or FIOS?
    - How are your self-service offerings for TV diagnostics?
    - Numerous temporary offerings that don't carry through due to Openband's relaying vs direct provider, etc.
    - How are your channel offerings vs the competition?

    And on and on and on...

    Steve. those are offerings.. lets compare speeds and bandwidth technology.. and yes I did sign a contract and acknowledged its presence.

    Openbands internet service is good. Their Telephone service is worthless and TV service is mediocre at best.

    Yes, they give you 100mbs service.. which back in 2000 sounded amazing... but in reality it isn't anything special anymore. But if you think an ISP should only be measured by it's max carrier speed you would be sorely wrong.

    But let's play your game... 100mbs... wow

    FiOS offers 75/75 for $70.. is that last 25/25 worth 2x more?
    Comcast offer 50mbs for most things.. and has packages for 105mbs and higher.

    What kind of switch and wifi router is Openband giving you these days? Multi-array 802.11n routers like everyone else?
    What kind of free hosting are you getting with Openband?
    How about that crappy double NAT setup they use that prevents many inbound services from working?
    What's your reliability like compared to other fiber providers like FiOS? (We have the history logged here...)
    How is your customer experience dealing with support? How's the feedback on your tickets?

    So Mikeo - you keep talking about how Openband compares. I've laid out some black and white points. You tell us what's so great about it for the rate you pay? Heck, tell us whats so great about it at any price?

    I don't remember any internet outages in the last 2 years. Internet service has been extremely reliable.

    I use TiVo roamio for my DVR with on cable card. Only a dollar more per month than open bands DVR and is way better than any cable provider DVR.

    I agree that Internet service is reliable. However, I reported a recent outage to OpenBand (slow Internet connectivity to some sites and loss of connectivity to others) at night on July 26, one that OpenBand let me know was system-wide.

    Netflix? He gets Netflix? With my OpenBand Tivo, I only get Amazon Instant Video.

    I'm so glad I have Fios. I can stream Spotify, play an MMO like Diablo III and watch a football game on another monitor all at the same time with zero lag. Not to mention my multi room DVR can record up to 6 shows at the same time.

    Both Landsdowne's and SWHOA's lawsuits have serious purpose.

    SWHOA's legal team is inept, but that's a different subject altogether.
