Need Advice Neighbor's fence install on my property

    My neighbor is in the beginning throes of fence installation. They are new, and yes we've met. But this is awkward! I watched the surveyors do their thing when the home was purchased. The surveyors could not locate the rear point of the property, but just behind the house, they placed a bright pink ribbon on the property line and one up on the curb as well. If I were to pull a string from the front of the house to the backyard, their fence flags are off by more than a foot!

    I don't have access to their surveyor report. Wouldn't the fence company be required to do another survey?

    I don't want to be THAT neighbor but I'm concerned they will install without checking. PS, as a side note, we've now learned that the original homeowner installed their sprinklers on our property, but so far that hasn't been an issue for us.....UGH!

    Call the HOA office to verify an application has been submitted and to, hopefully, have them run out an speak to the homeowner.

    We had a similar thing happen to us, what we found out was the builder and site Supervisors stated was our property lines was off by 10'. I would suggest you talk to the neighbor and their contractor and with their tools should be able find the exact location of the property lines. Our neighbor stopped her fence contractor to talk with us over new boundaries before installation. Together we found the corner pipes and the contractors had the correct locations and her fence was installed. We have been neighbors for 20 years and I couldn't have asked for a better one.     I would talk to your neighbor first to see if they will work with you to come up with a solution- you might need to do your own survey. If they are nasty to you - I’d start looking for a real estate lawyer who can advise you what your rights/options are if they move forward and put fence in wrong area. If you never do anything about it, it will be setting a precedent for them where you are allowing them to keep the land by default-

    This happened to me many years ago in a previous home where neighbor was an ass as they were trying to put a fence over my property line- ended up having to get a lawyer to send a letter to them warning them that if they went over the property line, they would be responsible for more than just legal and court fees- we would then ask them to pay for damages to the yard etc- owner finally stopped and repaired everything at his own expense- we never talked after that But at least I protected my property values and sale when I next wanted to sell the house-

    if you let it go, chances are it can create problems with thr sale of your home to next buyer-
