Cars in Driveway where tags have expired for more than several years

    Nope. That JOB is up to either the HOA *AND* the County Sheriffs to do the enforcing of the rules/ordinances. I am just merely POINTING out that there are potential violations on that street. As you have seen above, not only I commented here but so did KTdid and SHIM as well.

    Really, it is up to the board and county police if they don't want to enforce the rules that Virginia and/or HOA implemented. If no one wants to enforce the rules, then why were these implemented in the first place?

    Have a good evening and I'm closing out this thread as I've said what I've wanted to say. I'll always leave either positive or negative comments on the forum whether you like it or not. Just a thought: why don't you just simply move to a NON-HOA community so that you won't have to "listen" to "ramblin man" stuff such as this. You can then live in peace without having to worry about anyone commenting about potential "violations" in the neighborhood when it comes to cars. Me thinks you wanted to counter-comment out of boredom. :joust:

    Nah, I was here first! :p And FWIW, I have served on a HOA committee for over 15 years to serve our community that I love to show support, not just snipe with online posts.
    And yes, these forums are good for entertainment every now and then. Thank you for helping with my boredom.
    Now got get your ruler ready, spring is coming and you can go measure your neighbor's grass height. ;-)

    That house is the WORST! In fact, between Cloverleaf and Ridgeway there are regularly 2-3 homes that make walking on the sidewalk impossible due to their cars blocking the sidewalk.

    Very funny!!!! No one will ever catch me doing that....but my neighbor and I are are kinda anal about trying to keep our yards looking good unlike some other homes elsewhere where the grass height is almost the height of a basketball goal....(I know Im exaggerating but ya know what I mean!)

    I know, right? It seems like they are THUMBING their noses at the HOA and County regulations about blocking the sidewalks...the county cops couldn't care less because they have been called before and refused to come out for that. Go figure. Believe me, during the summers, its going to get worse with that house.

    i have been amazed before at how close some of those cars are parked close together and the efficient use of the space. Annoying as all hell...but i just have to drive by it every day, not live next to it. I don't know how many people live in there....but there's atleast 7-8 cars outside.

    At least 2 of those cars (1 in driveway and 1 in street) have expired tags that are more than 2 yrs old- one of the cars was BLOCKING entire sidewalk path today- that house is starting to be a real nuisance- seriously. Glad I don’t live next to them or on that street!!! Phew!

    A vehicle parked on private property (e.g. private driveway) and not being operated or parked on a government roadway or parked on public property or property open to the public (e.g. store parking lot, metro parking lot, etc...) with expired tags is unenforceable by the HOA. Infact, and I'm stating this as a retired LEO (30 years); the county sheriff's office and the state police can't even enforce expired tags, inspection stickers, or other vehicle related maintenance violations while parked or operated on private property. Once said vehicle pulls onto the county/state road, the operator can be pulled over and appropriately sighted. Even though Broadlands is a HOA, unless the vehicle in question is in violation of one of their cosmetic related polices (example: parked on blocks in public view), there is nothing any HOA can, or should do, about an otherwise maintained vehicle displaying expired tags on private property.

    Check out the HOA’S own documents here....specifically on 2nd page A2. HOA states: “A vehicle shall be deemed to be a junk or derelict vehicle, if it does not display valid state license/registration or inspection sticker or if it is missing any necessary parts, such as, but not limited to, tires (flat or inflated), wheels, engines, door, truck, hood, wrecked or smashed body parts, etc. that are necessary for the operation of the vehicle on public or private Streets.”

    Don’t like or disagree with the HOA? Take it up with them, not me . I couldn’t care less if you are a LEO or not. Everyone signed the covenant documents agreeing with it when they bought into the community and HOA can enforce it since it’s in the HOA covenant documents and they should enforce it if they drafted the rules. If they no longer want to or they are unable to enforce it, they then should eliminate the rules from the documents. I suggest you take it up with the board if you feel it is unenforceable. We all pay dues and we all expect HOA to enforce whatever they have put in the covenants.

    While I agree with everything you say and discuss in all reality the HOA can't be everywhere and enforce everything every time. I think someone even pointed out when there is an issue like this, the HOA relies on complaints. Some people just don't like to complain...and hope inspections from the Covenants inspector catch these violations.

    Ratting on your neighbor is no fun and I'm sure being on the HOA and getting these complaints is no fun either.

    I agree with you and I’m sure the HOA decides what to enforce or not — all the while considering their resources to do so. If the HOA decides not to enforce any of their covenants, they then should strike the clause from the HOA documents because you can’t just arbitrarily enforce the rules for one house and not for another- it has to be consistently be applied equally throughout the community and not penalize one house over another. Right?

    The owner of that car probably threw the tarp over his “derelict” car that has NOT been moved/driven in three years because I assume he most likely hasn’t paid property taxes, registration fees and/or inspection fees on the car and wants to avoid attention on the “derelict” car (as the HOA document defines it).

    If he doesn’t want to pay his fair share of his taxes/fees, why not sell the car to someone else who can put the car to a good use and pay the fees/taxes on it. If it’s not driveable, one might as well put it in the garage or fix it up and sell it if you aren’t going to keep it up to date on registration and inspection- JMHO.

    The Sheriff's office/HOA will be more than happy to employ an army of enforcers to ticket everyone who does not walk the straight-line.
    But i am sure you will have absolutely no issues paying $500/month in hoa fees and $25,000/year in property taxes to pay for an army of deputies to bring down the full force of the law upon every fly that even momentarily flies the wrong direction!

    I see you are new to the Broadlands’ HOA forum....

    Your sarcasm is noted....

    HOWEVER.....

    If you don’t agree with the HOA Covenants regarding the license plate registration and safety inspection expirations, may I direct you to the HOA as they were the ones that drafted and implemented it— not I. You are more than welcome to try to get the HOA to remove the covenant declaration if you disagree with it or feel it is unenforceable even though everyone that bought a house in this community signed it at settlement so it, I believe, IS enforceable by the HOA and its attorneys if they choose to do so since it’s within the HOA documents. Don’t direct your ire at me — I am only merely pointing out that the “regulations” exists within the HOA’s books.

    If you didn’t realize it.....yes, there are good reasons why the HOA has these “regulations” on their books.

    Just to be clear...
    1) I never said i agree or disagree with the covenant and
    2) i never said it was un-enforceable
    3) I am not directing any ire at you. I am presenting a different point of view.
    My point is that it is a low-priority regulation...which is self explanatory...LOW PRIORITY & need not be AGRESSIVLEY enforced, unless it becomes an issue.
    Just cos the HOA "regulation" (or any rule/law for that matter) exist, alone does not mean it has good reasons. If that were the case, rules and covenants should never change.
    Every rule/law means you are giving up a part of your and someone else's freedom, the balance between the sacrifice of that freedom and the benefit there-from has to be continuously evaluated and re-balanced if necessary!

    Uh...ummm....

    If you haven't noticed, it IS an issue when someone doesn't want to pay their fair share of their taxes and registration fees for the right to drive their cars on our roads that we all have paid for with our fair share of the taxes.

    I am going out on a limb here and assume that not paying taxes, etc isn't a high priority for you. (Apologies if my assumption is way off here.) I believe that the county and state will keep on increasing our taxes/registration fees because the bulk of us are paying for those who don't. If you enjoy paying more over time to "cover" those that don't pay, more power to you. I am confident that the HOA will eventually go after those residents that do NOT want to abide by the HOA covenants whether it is high priority or not. They shouldn't be parking their unregistered cars within our community whether it is is HOA maintained or VDOT roads. I don't give a hoot if they park their cars INSIDE their garages but if they are going to be driving around in our community roads, they are violating the HOA covenants and that is where the HOA comes in and enforces it. If you hadn't known by now, the HOA has already gone after someone who didn't keep their license plate registration up to date for over the past two years when they have parked their cars within the community.

    If one doesn't want to abide by the HOA's covenants, they risk being dinged by the HOA. If the HOA didn't enforce any of the regulations in this community, the home values will decline over time due to the fact that people wouldn't want to live in a poorly maintained community. Some residents may place a higher priority on enforcement of garbage bins being left out on the street day after day and some may shrug their shoulders and say "meh" to it while others may place more emphasis on getting people to bring their cars into compliance on county and state regulations as it involves paying their fair share of their taxes/fees. Some prefer enforcement of the vehicles' registration and taxes over the trash bins because the trash bins doesn't involve paying their fair share of their taxes/fees? Should the HOA block homes from using trash services, etc if they don't pay their fair share of the HOA fees? Is it more important than the vehicle taxes/registration fees? I think both are equal and BOTH should have equal enforcement priority. Our taxes goes to pay for various costs that the county and state incurs. If they don't want to pay their fair share, then we all are going to have to pay "a bit more" to cover their expenses. Is that fair to you? I think not. Thus, we should enforce these covenant regulations as much as we can. If they don't pay up in time, they should have to pay late fees, interest, fines and so on until they are in compliance. Likewise, if they don't pay their HOA fees, they should have their HOA "benefits" cut off. Its the right thing to do.

    Its really up to the HOA staff to decide whether to enforce the covenants or not. Its their call. The HOA Board hired them and they trust they will do their jobs and fairly enforce all covenants here equally and consistently.

    FWIW, I've been dinged by the HOA for "small" violations before here and some of them are so minor that you'd complain that they fall under the low-priority regulation......If enough residents didn't comply with, even by your definition, the "low priority" regulations, there would be chaos here and residents who feel these "low priority" regulations should be enforced to the max would have a field day here with those that want to blow it off. My point is...all covenant regulations should be enforced equally and should NOT be placed either in a "high or low priority" ranking. It should be equal. Full Stop.

If you think that the HOA regulation doesn't have good reason, then why don't we all stop renewing our car registrations and stop paying personal property taxes? Who then will maintain the county roads and pay for county/state police, and so on?

    I don't feel that I am giving up my freedom here by living in a HOA community. If you feel/believe your freedom is constrained here, by all means move out and go buy a home in a non-HOA community (preferably an island) to your heart's content. Moreover, if there was no rule/law in this country/county/state, we truly will have complete chaos/anarchy. For example, we have traffic laws/rules because if we didn't everyone would either, for example: not stop at stop signs or yield to others at 4-way intersection, drive recklessly, and so on thus causing anarchy/chaos on the roads. Just because we have laws/rules doesn't mean that I am giving up my freedom. In fact, I would have freedom from harm/injury from others' maniac or reckless driving if we had traffic rules/laws in place rather than not having any. Thus, I strongly reject your argument of "Every rule/law means you are giving up a part of your and someone else's freedom..." I am free do do what I want in the community as long as it meets the "agreed upon" rules/regulations. Rules and regulations was established by the HOA to eliminate anarchy/chaos/disorder/harm/disagreements/fights within the community and to help keep the home values from declining as a result of not following the rules.

    'Nuff said. I'm bowing out of this thread as I've said what I wanted to say. I trust I made my point clearly here. If not, you are welcome to argue your points with someone else (or even with yourself) as I'm moving onto other things.
