yes, exactly! AND once you get those points, you get an annual fee for every year they are on your record, 5-11 years.

yes, read the fine print. don't accept the positive spin as gospel, there are always reprocussions and negative sides to these kinds of laws. not only are we slowly giving away our freedoms, too many people seem HAPPY to do it!

sure, i want crazy repeat offender drivers and drunks to have serious consequences, but this is not the answer, it's much more encompassing than that. ...reminds me of the silly minimum mandatory drug laws that eat up so much of our tax dollars, but that's another topic, and it probably belongs in the politics forum. ;)

money grab all the way. this is insane. we should bring the hammer down on DUI's and those who fly in residential areas, but do you know how easy it is to drive 15-20 mph over the speed limit without even noticing you're doing it on a highway? sometimes the entire traffic flow on the toll road is 15-20 above.

You bet it's insane. Says it all in the second to last paragraph: "It's basically the Lawyer Full Employment Act," cracked one Fairfax lawyer, who spoke on the condition of anonymity because he stands to benefit from the new law.

Can any numbnut politician introduce legislation like this and have it go through because he's scratching some other politician's back? What's next? Let's tax everyone $20/lb. per year for every pound over their ideal weight. Want to curb growth? Slap a $5,000.00 "civil remedial fee" on every mother right there on the delivery table. Don't cover your mouth when you sneeze- $100.00. More politicians, more inane laws, more attorneys, more money, more money, more money.

Any way I can pass a law that requires these idiots to flip burgers if they even think up something this stupid? (I'll scratch your back if you scratch mine.)

I think the inmates are running the asylum.

How many points are earned for a speeding violation?

??? You get a fine based on the mph over the limit plus court fees. Nothing else.

    Not today you don't.

Plus, every year you don't get a ticket, your point total goes down 1. And most citations don't last that long (only things like Reckless and DUI last a very long time.. most are 3-5 years).

8 points is really only 2 or 3 tickets.. and given how slowly your point totals decrease.. that is not really that excessive to think if you got 2 tickets in 5 years you'd be concerned.

This type of law is stupid... if you want to penalize people.. that's what the COURT is for.

From personal experience, I know back in the day it was 3 points for speeding and 6 for reckless. Please don't hold me to this, but I believe that now it is 4 points for speeding and reckless is still 6. You can be written up for reckless any time you go 20 or more over the limit. I think it's reckless if you go over 80 as well.

"Excessive" by who's standards or definitions? Do you think a couple grand is excessive for someone drinking and driving?

The US is one of the most tolerant countries when it comes to DUI's. Adopt some other countries laws and see how fast DUI's decrease.

    Some examples:
El Salvador - death by firing squad.
Finland and Sweden automatically sentence drunk drivers to one-year jail sentences including hard labor.
Norway - jailed for three weeks with hard labor and loses their license for a year. Repeat offenders lose their license forever.
South Africa - 10 years in prison or the equivalent of a $10,000 fine and, in some cases, both.
France - $1,000 fine, imprisonment for one year, and loss of license for three years.
    Bulgaria - 2nd offense, execution.
Turkey - taken 20 miles from their town and then walk back with a police escort.
Poland - jail, fine, and even worse, mandatory attendance at political lectures.
England - $250 fine, a year in jail, and then loses their license for one year.

Here is the link to see the list of offenses and how many points they are in Virginia and how long they stay on your record. It's a pdf and you need to read page 2 before page 1.

i could be mistaken, but i don't think anybody is arguing about the DUI fees here.

the fact of the matter is that the law is discriminatory (to both in-state drivers, and the poor, IMO). ...and they don’t fine out of state drivers because they have no way of enforcing the fee?!?! well, perhaps they should just give up writing tickets to out of state drivers, period. If it’s not a reciprocal state, we can’t enforce it anyway, right? Why waste the paper.

Much less severe driving violations are subject to these large taxes. Albo himself submitted the fee proposal, and he is also a partner at a traffic law firm. He stands to profit from both sides. Can we say conflict of interest, and yes, as Dutchml so succinctly put it, unconstitutional? I’m actually shocked it took until page 3 for someone to come to that conclusion.

I'm not sure where The DUI thing came from either. I'm pretty sure the federal courts won't take this up. They should stay out of state issues. We need to vote these fools out. Talk about "big government"

I just threw DUI out there as an example.

And yes, IMO the law is discriminatory, just like the actual enforcement ;).

But there is a simple way to avoid the fines...

    Not only stupid, it's unconstitutional.

That's why it's not a fine. It's a tax and that's why only VA residents get the pleasure of paying it.

At this point' I'm just happy as a clam making a pearl. Maybe this will keep the crazy driving down. I keep saying Nothing will amaze me anymore, but it happens over and over. One day, perhaps all these people who think they are driving "stealth" cars or that turning signals "Were optional" that year, "Oh you wanted to be here, instead of in your lane?" Or...well you get the picture!

Coming down Claiborne from Rte 7 yesterday I watched as a sheriif's car just moved lazily through cars as if they were orange cones in a driving test...and NEVER used his signal. Then he sped up after going through the intersection by SHBS, but his rack lights weren't on...good way to set an example for the rest of us.

BTW, people are still under the regular rules of the road here. Anybody coming from out of state who drives at a reckless speed or drunk will still get a ticket. Maybe not the fines we pay, but still will have some fee and poitns on their records.

Good luck trying to deduct it on your income taxes. Course, this is not something I have to worry about since I'm a perfect driver- never speed, always signal, stop on yellow, etc. Heck, I even get out of my car to help little ol' ladies across the street.

Note the time and car number and report them. I had Fairfax cops blow past us at about 100mph with no lights on in the past and filed a complaint on the website. I got a call and investigation very quickly afterwards.

Cops are not above the law, and they have specific policies they are to follow.
