    Sorry, but I don't see how this is going to affect you. It's not going in your back yard. It's not tearing out the beautiful trees you were promised would always remain. To keep everything "as right as it can be" would mean remaining true to the original plan that was presented to the homeowners. Anyway, I think that when people are looking at buying a new home things like good schools are more important than the location of the nearest tot lot.

    Couple of points looking it from other angles that were dicussed on this forum in the past .

    Did you get that in writing from VM ? As I recall, verbal "promise" does not hold to much weight. Since as we learned from this post, many many homeowners were promised several different versions of the "promise"

    Looking at the attachments that was handed out at one point by VM. See the attached docuement. Does it not say and I quote ""The land plan may be amended from time to time, and Buyers of property in Broadlands should not rely on the future development of Broadlands as shown on illustrations, depicitions, or maps. " Which mean VM did a nice job covering their rear as to homeowners who expected this park. Don't you think ?

    I think we can all agree that VM did a great CYA job with their sales material, contracts, etc. I'm sure we all signed our life away and VM has the advantage. And I'm sure that we were all promised things verbally that we never got in writing. So does that mean we should just roll over and let them off the hook?

    The only way to prevent VM from tearing down these trees is to make it clear that we intend to hold them to their promises. Home buyers were promised a "tree save area", they were promised the privacy of a "backs to woods" lot. It should be obvious to everyone that this has an impact to the property values of the lots bordering the area where the tot lot is planned.

    It is time that someone stands up to them. VM has to comply with Loudoun County guidelines for these tot lots, and the tot lots have to go in before they can fulfill their obligations and turn over this section to the HOA. They have a vested interest in resolving this expeditiously.

    A unified group of homeowners can make a lot of noise. If nothing else, VM's image as a reputable developer (if there is one) will be affected...and with the tough times in the housing market they may be a little more willing to listen.

    rich DOES want to hold VM to their plans. He wants the tot lot in the ORIGINAL location.

    Something to consider about VM's "promise". Do they even own the land? If they don't then sure, they could easily state "WM will never tear out those trees" but another developer could. ;)

    So why's he pushing so hard to have it in the woods in a location that deviates from the ORIGINAL plan?

    Someone did... a homeowner filed an injunction which is why the tot lot never got built on the second location even after they cleared it and built the bridge.

    Not that I know what he wants since I do not know him. But it sounds like he JUST wants a tot lot nearby.
