HOA considering restrictions on home-based businesses? (merged)

    Right now there is no text which is why no one has seen it. This all started at the May board meeting where several residents came to the board to present an issue they were having with a specific home-based businesses on their street. After a lot of discussion the issue was tabled until the June meeting. The HOA has a right to implement restrictions above those the state, and county require. However at this point (not having been on the actual board) I am not sure what the majority of the board members feel is appropriate. As I stated before, I want to make sure that the restrictions that are in place are being properly implemented before we begin making new ones.

    In the summer, this is a lot of cars coming and going when all the kids are out of school and playing outside.

    Hopefully not playing on the street. Maybe I can start a petition to the HOA to restrict kids from playing on the streets.

    I also want to add that I have no problems with restrictions. No matter how strict it may seem. When one buys a home with a HOA one agrees to those restrictions. You know what you're getting into.

    Placing restrictions after someone has moved in should not be taken lightly. We're not talking about garbage can storage or fencing material here. This may be someone's livelihood. And this not only affects them, but also the other residents who use the service.

    If you consider the folks at the end of the 'sac, prior to this they only had to concern themselves with just 5 other families that lived down in the circle, coming and going. In the summer when/if the State licensing gets approved, their child care business will have 9 children in the 1st class and 9 in the 2nd class, assuming no more then 2 classes... and they might actually have more classes. This means those 5 families will have to contend with an extra 18 parents, dropping off (2 trips) and picking up (2 more trips). And as SportsFan said, that pickup and drop off in between classes happens at the same time.
    In the summer when kids are running around playing (in or out of the road, which is a separate thread), this amounts to 3-4 times more traffic to contend with..... on a cul-de-sac!
    For people living on chickacoan trail, or vestals gap, I think we can surely assume that this additional traffic would be barely noticeable.

    At least there will soon be a hospital nearby in case all of this extra traffic causes an accident :)

    I want to say something so bad here, :devil2: and don't take me too seriously but....... with all the germs and bacteria running rampant in the broadlands perhaps the hospital land should be left for a big dirt pile which would keep everyone healthier then the hospital if they all played in it. :devil2: I really did play in the dirt all the time and sometimes still do and I am rarely sick ;);););)

    heh.... you know.... I was thinking that very thing after I heard they presented the "new" plan for the hospital at the HOA meeting.....

    It sure sounds reasonable to enforce the rules we already have before adding to them. Thanks, Staci.

    Could the people that raised this issue at the May board meeting please propose text for the new restrictions that they want? Like I said earlier, if you are not trying to stop people from working from home / telecommuting, I think you could avoid a whole lot of anxiety by being open, honest, and forthright by posting your desired restrictions here. That way everyone could evaluate it and make a personal decision. Until that happens, I think you are going to have more anxiety than anything else from people who just want to telecommute from time to time (or maybe all the time).

    Just a guess here, but I think it's the traffic issue. Someone telecommuting wouldn't be generating this type of traffic.

    Thanks for your opinion. I will again point out NavaNative is the spouse of someone who's business work I was not happy with.
    How thick was his skin?

    And I will ask you to reread Mrs.Smith's post again objectively, and tell me that it was a fair and reasoned comment.
    If you think I should not be able to respond to such comments because I am the "HOA President", then we will just have to disagree.

    Who knows....you may get your wish!!

    Okay, well again My comment was in response to your comment of the "one car I missed that was speeding".. That was just as sarcastic as my reply of Mr Prez.. But for you to say I lost all credibility was unfair.Because you took it to a whole other level with the walkie talkie comments... You have the right to respond to anything, but you have to realize over a year of dealing with something can take a toll on you.. And realize sometimes things are out of frustration

    What I'm curious about, Mrs_Smith, is to hear EXACTLY what you want to rectify this situation...and what is YOUR proposal to to the HOA to resolve this issue.

    What I am looking for to resolve this issue is that there is no longer a preschool business functioning in as large of a capicity on my street. 3 or 4 children would be fine, But, Mrs Baker has stated she does not want that small of an amount.

    In my opinion, the 3 or 4 children should be in a 24 hr period and not 3 or 4 in the morning and 3 or 4 more in the afternoon.

    "I was on Fernbrook Court this morning and observed several cars come and go. None of them were driving too fast.
    Obviously, I may have missed the one you saw."

    My intent was to let you know that I do take this situation seriously and am taking the time to learn more about it.
    Coincidentally, I was on your street the day you made this post.
    I commented that I did not see any speed ing cars, but qualified it with the fact that I couldn't have seen all cars my few minutes on the street.
    It wasn't intended as "sarcasm" and I was not even aware it was perceived as such.
