Barking dog question

    Hi everyone

    We're having an issue at our house with a neighbors barking dog. Our neighbors leave their dog outside constantly - and it barks almost non-stop all day long (and they are home!). They leave it outside when it's hot (over 90), cold (in the 30's/40's), raining, etc. We've tried talking to them without great luck. It's making my wife and I nuts. Has anyone else dealt with this?

    Here's the law:

    <Law>
    Dog noise. For any person to own, possess or harbor any dog of any age which frequently or for a continued duration howls, barks or makes other sounds which annoy or disturb a reasonable person of normal sensitivities across a residential real property boundary or through a partition common to two persons within a building. No action shall be brought under this paragraph unless the alleged offense has been complained of by at least two persons not of the same household, unless there is no more than one household within one-half mile of the property line of the property on which the source of the complaint is located, in which case one complaint shall be sufficient. Complaints shall be made in writing to the Department or by telephone to the Sheriff’s Office. Complaints received by telephone must be verified by the investigating officer at the complaint location, in order to be considered valid. When the complaint is verified, a notation will be placed in the Computer Aided Dispatch system reflecting this violation. Any subsequent valid complaint at this same location will constitute a second offense and a citation may be issued.

    Which means you really have two options. The HOA or get one of those ultrasonic devices to train the dog to stop barking. I saw a few of those by doing a google search.

    Since its a neighbor's dog, and they don't seem to mind the barking, I seriously doubt that they would want to spend any money on stopping it.

    FWIW ... as Homer pointed out, if you and another neighbor complain to the Sheriff's Dept, they will send out an officer to verify the complaint.

    Its interesting, that if you send in a written complaint, there is no requirement for an officer to appear. My advice is, if you find an adjoining neighbor or neighbors who are fed up with the noise, get together with them, sign a letter, and send it into the Sheriff.

    However, here's another area that you and your neighbor's can use. Under the Declaration for Broadlands, Section 8.2q ANIMALS - it states: " that any pet causing or creating a nuisance or unreasonable disturbance or noise may be permanently removed from the Property upon ten days written notice from the Board of Directors. "

    I would assume that there would have to be a number of complaints made prior to this action being performed, but you do have a few options. You do not have to put up with the consistant barking of a neighbor's dog.

    One other thing you may want to look at. If they do leave the dog out in heat and freezing cold without any sort of shelter or water, they could be in violation of Virginia Humane laws.

    That would most definately be cruelty. You have to have a shelter set up for it to be ok, be it Summer or Winter. You just can't lock your dog up in an inclosed space like that just because the dog is inconvenient to your life style. Makes me soooo mad to see that. Homer Angry!!!!!
