Know a good HR attorney

    A friend of mine was fired from a company last week while on Medical disability leave and the supervisor dispersed her entire medical history to the entire staff. She is in desperate need of an attorney does anyone have one they can recommend

    If you don't get any answers, I recommend looking at the Washingtonian Magazine for top area lawyers that represent employees that have been aggrieved. That is horrible that some supervisor did that unethically and illegally. I would hire the BEST lawyer that would take action against the company AND the supervisor.

    You also may want to contact the Virginia/DC/MD State Bar Association as they could probably refer you to several lawyers.

    Remember, legal fees can be expensive but in the end it may be worth it considering what she/he has been subjected to.

    While I do not have a recommendation please let her know she would want to talk to a plaintiff's employment lawyer.

    Very sorry that happened to your friend. Unfortunately, an employer can terminate an employee on disability, so long as they've followed FMLA and ADA rules. Was her personal infomation disseminated to "Board" or Executive level members only?

    From the original poster's comments, looks like she said "entire" staff...seems like the entire staff that she was working with? If that is the case, its really wrong and illegal.

    I recall a neighbor of my parents was terminated more than 20 yrs ago when he was on medical leave and he had no recourse at all because the company had followed all the legal routes at the time. Most corporate attorneys are VERY strict about that before they even THINK of terminating someone on medical leave...

    She knew it was always a possibility but the way it was handled was very poor. I know that does not mean it is illegal or unethical, but with the sharing of her medical information I believe there is a good possibility other rules were broken as well.

    My understanding from her was that is was not only her board but also subordinates that now have her info.
    I personally have no idea if FMLA or ADA rules were followed - she was the one asking me for help finding an attorney so she seems to think they were not.

    I am not sure what is the best option for her at this point. All I can do is arm her with info and I know this forum seems to be a great source of information. So thank you for your help

    Your friend might want to go to EEOC first and file a complaint with them but a lawyer will get it done faster with EEOC

    Meh, unrelated shot at Delegate Dave Albo who has consistently voted to make VA's DUI laws some of the toughest in the country while marketing his firm as a DUI lawyers for maximum profit. While it is a cliché to point out that lawyers are often sleazy, this guy really does milk it. Also, they would likely be assigned a junior lawyer out of the gate unless they whipped out the big money.
