Renting Basement - HOA Rules or Cty Zoning

    Are there HOA Rules or County zoning laws against renting out a basement of a Single Family Home in the Broadlands? Learned of a neighbor planning to rent out their basement to an unrelated renter. I know work has been done to separate the space from the rest of the house...not sure if it includes a separate kitchen.

    Not sure why there would be a regulation against this, unless the house has way too many occupants. As long as there is a safe means of egress in case of an emergency and sanitary facilities, it seems like a benign issue. If I needed the money and had the room, I might consider doing the same thing......

    Did your neighbor ask you if it was against zoning/hoa laws/rules?

    Unsure if the HOA has any restraints on this.. but besides occupancy rules and building code stuff (like disallowing second kitchens).. unless you try to disallow access to the rest of the house, I doubt there is much restriction to it. When it tries to be a separate dwelling, is when things become more regulated.

    I've attached Loudoun County's regulation on occupancy for residential units. I believe it is based on a total sqf, relationship etc.

    Hope the attached doc answers your question, if not I believe the attachment has contact information for the County's zoning department.
