SWHOA annual meeting and elections rescheduled for Jan 16th

    Incredible...I wonder if the lawyers now are viewing SWHOA as being their cash cow account because we are spending so much $$$ on legal costs. Sigh.

    Been a cash cow account for a long time considering their track record. Glad for Shashi, hopefully this will end well so things can improve for Southern Walk.

    Yea, I do know or have any control over voting happening tomorrow but that was the concern with having an injunction. There is an emergency hearing this morning so we may know more soon. I am waiting to hear (officially) with the rest of you. I think one of the key points will be to determine Shashi's standing and his eligibility to run for election. As of right now, my understanding is that he is not allowed to run (according to the Board)... so that needs to get figured out.

    This morning, the Judge denied my request for temporary injunction. Judge disagreed with our claim of irreparable harm as we can still file the complaint after the elections. Court made no decisions on the merits of the case today.

    There were about 2 dozen in attendance. The quorum was met with the mailed in ballots and personally solicited ballots. The three people, whose profiles were previously distributed, were elected to the board. The attorney recapped where we are. There was discussion about the cost of the meeting, the ongoing litigation, and that was essentially it. No real drama. The litigant was there and tried to speak but was ignored by the board since the case is not completely resolved.

    Yes, there was a similar cost discussion in December when they had a total of 39 out of 1100 people vote for the annual election (111 needed for a quorum). In the mailing for the January meeting, there was a postage paid return envelope included (the December mailing said there was a postage paid return envelope included, but there was not - someone really needs to proofread the text that goes out in these "costly" mailings). So a lesson learned is that while including a postage paid envelope will increase the cost for the the meeting, it is much cheaper than holding two meetings.

    Hopefully, the other lesson learned is that the Board needs to change things up in some way in 2014 to increase the participation from just achieving a 111 person quorum after two attempts (with only ~24 people in attendance) to getting more involvement of 1100 homeowners.

    This problem isn't unique to SW HOA. The Broadlands HOA has over 3000 homeowners, and I think about 25 showed up to the last Annual Meeting. And that's with Newsletter articles, mailings, and forum postings. We still make the quorum by virtue of the Developer (and their votes) still being on the Board.

    Just my thoughts-I think some folks, myself included, just find everything about our HOA abhorrent. The infighting, accusations and counter-accusations get mind numbing and I find myself not knowing what to believe or who to believe. The easy response is to take a step back. I don't have answers or solutions, but just one of the reasons why participation is so low.

    I feel just the opposite.. after all the antics of the last year, if that's not motivation I don't know what is. It's complacency that has reached so deep, people are going to start assuming they are invincible and go even FURTHER. When the board can't defend themselves in the open air without trying to get rid of those who question them.. the air is full of STINK. The residents really have no one to blame but themselves now.

    The only thing that seems to make noise is when the bill goes up. OB quite coyly has avoided raising the bill while being challenged. Once the court fight is over due to running SWHOA ragged or by court order... get ready for the big bill spikes. And then all the woe is me will come out again... too late.

    Flynnibus....I hear what you say and I am tempted to believe you on the second paragraph. I personally know someone who has a family member inside of OB. That person said that OB has very DEEP pockets and is willing to go all the way to VA Supreme court and other court systems to protect their business and cash cow. They aren't going to go down without a good fight is what I am hearing. We, on the other hand, have limited financial resources. If we win, great.....but Im not optimistic as we haven't won solidly yet. If we lose, God help us all as they will try to collect reimbursement for their legal fees and probably will fight further to get their franchise reinstated. This is one hell of an expensive fight, I have to say.

    We have not won anything yet. Our lawyer should have been fired the first time our suit was thrown out yet here we are years later with the same lawyer.
