    It's ok, I'm here now with another peeve Chsalas (the your/you're thing wasn't directed at you only, sheesh! =) )....

    People who post "first!" in comment threads.... sometimes people even start counting up. This drives me nuts... :angryfire:

    Correction! Apparently when the Geek Squad at Best Buy sent my laptop for repair they sent it to their own repair center, not HP. I had assumed they had sent it to HP... So I guess my beef is with GS, not HP. But I'm still laptopless for at least another 4 or so days. :mad:

    why do doctor's send you for tests, for a potentially serious problem, worry you sick and then don't call you when the test results come in. why do they make you wait for 5 days to give you the results and the results are there coz the nurse told you they came in!! aagggghhhhhh

    To the motorcyclist who find it necessary to drag race on Claiborne Pkwy (especially on Easter Sunday) & run the 4-way stop.

    I hope you get busted by the Sheriff’s office and lose both your Motorcycle & Vehicle license. Your reckless drag racing endangers other drivers & pedestrians in our family oriented neighborhood. A driver’s license is a privilege, not a right.

    I hope not!!!!! Pet peeve: lukewarm coffee now served everywhere because some doofus dumped it in their lap!

    It was not the fault of the woman, it was the fault of McDonalds for serving coffee 60 degrees hotter than the industry safety standard.

    McDonalds got what they deserved. :angryfire:

    Ozgood, it wasn't 60 degrees. There was also no set 'standard' at the time of the incident for coffee temperature.

    Direct quote:

    "During the case, Liebeck's attorneys discovered that McDonald's required franchises to serve coffee at 180–190 °F (82–88 °C). At that temperature, the coffee would cause a third-degree burn in two to seven seconds. Stella Liebeck's attorney argued that coffee should never be served hotter than 140 °F (60 °C), and that a number of other establishments served coffee at a substantially lower temperature than McDonald's."

    So at most, the coffee was between 40-50 degrees hotter than what other establishments served their coffee.Notice that the attorney never stated that the other establishments sold their coffee at 140 degrees; only that they sold it at "a substantially lower temperature than McDonald's". That could mean anything in between...

    I would be surprised if you could find a true coffee aficionado who would agree that coffee should 'never be served hotter than 140'. That's ludicrous...

    Furthermore, the courts decided that BOTH parties were at fault:

    "Applying the principles of comparative negligence, the jury found that McDonald's was 80% responsible for the incident and Liebeck was 20% at fault."

    So, yes, it WAS partly the fault of the women and your 60 degrees statement is false and exaggerated...

    I will grant you that one point. I incorrectly remembered a 60 degree difference, when in actuality the difference was 20-30 degrees. I do apologize for the error

    Despite my error, McDonalds still was guilty of serving coffee above the industry standard and they had settled over 700 cases of people, including children, who had been burnt by their coffee. There was simply no way McDonalds could claim that they were unaware of the hazards of how they choose to serve coffee.

    It was my intention to address the myth that this was a frivolous lawsuit when it was a valid one.

    The whole case was settled out of court for less than $600,000. Please indicate your continuous reference to this 'industry standard temperature' for serving coffee... Your own link above states: "The coffee was served at 179 degrees, which is within the industry standard of 175 to 185 degrees."

    I still think it was frivolous. Many, many coffee drinkers want their coffee piping hot. If I spill hot coffee in my lap I expect to be burned (not that I want to be!). If it had happened to me it would never have occurred to me to sue the place I bought it. Drinking and driving don't mix when it comes to liquor or hot drinks!

    Personally, I'm an adult, I can pretty much take my actions as my responsibility (to include inebriated states too) and if I order hot coffee, I expect it to be hot, and if I burn myself, well then I am a dumb---. That person who burned themselves, regardless of the temperature was, ( I assume under 212 degrees f) should be held accountable for her own actions. It's spilt, and it's on them. (no pun intended)


    Like Flynn said, no one take personal responsibility anymore and that's just sad.
