Construction Fraud: Basement

    I entered a contract agreement with Darryl Metz and Nyree Skinner to have my basement finished back in August 2005. After three months of destruction (not building), Darryl Metz decided to abandon the project.
    What I mean by destruction, here is a short list
    - Concrete in the basement was busted up (to run the pipes for plumbing). As the results, I have debris, gravel and dirt were all over my basement.
    - Framing was done incorrectly (not plumb and level, was off at least 5 degrees). Studs were 26-28 OC (on-center); rather than 16 OC or 24 OC for non-bearing walls.

    After contacting the sheriff's office, I was informed that Darryl Metz had ripped off nine other homeowners in the Ashburn areas (Belle Terra and Loudoun Valley Estates Community).

    Oracle, I'm not a lawyer, but check with your attorney about your above post to make sure that you don't get accused of defamation, etc. I wouldn't want a kind gesture, such as a warning about a contractor, to become something they can turn around and use against you when their chips are down...

    Just a thought...

    AFGM, if you have something against a post I made in another thread, why don't you reply back in the original thread instead of trying to hijaack this one? We *were* having an intelligent conversation here...

    Commonwealth US Attorney had filed charges against Darryl Metz and are set to go to court next week, March 13th. Prior to these charges, he was convicted on construction fraud in Prince William County. This is recorded in Circuit Court and the cases are available to the public.

    A few of us took him to civil court and won; however, he has not paid a dime. With the amount of money that he had ripped off from the homeowners (myself included) and the number of civil cases in judgement against him, I would be extremely surprised that he takes me to court. If he does, I welcome it.

    Anyway, after dealing with these matters for the last five months and some, I thought I will pass the info along to prevent future scams on the homeowners.

    Just so you know, as long as what you say/write is the truth, you cannot be liable for demation/slander/libel. "Truth" is an absolute defense to these torts.
