HOA Question Fines

    Hello,

    I was debating today with a neighbor how fines probably work for noncompliance violations in the neighborhood. He was saying it's probably a small fee for everything but is only issued once per complaint, I was saying it's probably a fee on a per day basis until remedied. Either way, we have no idea haha. I tried to look for a list of fines on the website, is there such a thing?

    A state statute, the Virginia Properties Owners' Act dictates how assessment of charges can be leveled for Association violations. Section 55-513 "...shall not exceed $50 for a single offense or $10 per day for any offense of a continuing nature..." "...total charges for any offense of a continuing nature shall not be assessed for a period exceeding 90 days."     Wow I had no idea. I guess we were both right and both wrong. So, by my interpretation, if someone left out a trashcan they could be charged $50 for the 1st day and $10 every day they don't remove it up to 90 days (or $950 in total - ouch!).

    It's probably the same if someone paints their house pink; although, what happens if they are happy to just pay the $950 fine?

    For example...$50 everytime the trash can is observed out on non-pick up days...$10 per day up to $900 for everyday your deck remains painted a nonconforming color.

    If after 90 days the violation still exists a lawsuit can be filed...it gets really expensive after that and a court can order the violation be corrected.

    Speaking of trash cans being left out--there is one on Ridgeway that doesn't seem to have an owner. It's been on the street now for close to a week and no one has claimed it. Is there a way to get it removed or sent back to Patriot?
