Lawsuit Pending against HOA

    Is everyone aware of the pending lawsuit against Broadlands HOA? I found out through my mortgage company while in the process of refinancing. [:0]

    Suzanne Watson (plaintiff) is suing Broadlands for $2M plus prejudgment interests, costs and any other relief because she claims to have fallen in a trench somewhere on Demott in the common area while walking her dog on Nov 16, 2001. Lawsuit filed Nov 10, 2004.

    Did the lawsuit effect your refinance?

    I'm assuming the HOA has insurance that would cover a judgment against it in the event that it is found negligent, but it will surely increase our insurance rates. Which, of course, will come back to us in the form of higher HOA fees...

    Which would make the plantiff very popular in the community. :) Although, I would assume she'd move once/if she gets her windfall.

    Let say HOA lose this one / settle this one ... Does that mean our HOA fees will go up to cover the cost of increase in insurance fee ?? HAAAHAAAA :D

    I don't know how wise it is to post that, seeing as how we already know she seems to be quite the litigious type (even though the information you posted is readily available public info).

    Were there any injuries suffered by the dog? Is he named in the lawsuit? I would hate to see the poor dog that took a tumble miss out on a new diamond studded collar and matching dogbed. :D

    I would like to know why my post was edited by the admins?

    What rule did I break? I just checked the forum rules again
    and could find nothing prohibiting the posting of a link to web
    site that contains addresses, maps and other personal info.
    This is public information.

    I did not post the womans name on this list or reveal that
    she had filed a lawsuit against our association but this is also
    public information.

    I only posted a link to http://directory.superpages.com/people.jsp that
    searched for her name. Super Pages is run by Verizon and most
    people who have phone service are listed there.

    Her suit is public and so is her info. I would like an explanation.

    The admins (and these forums) are accountable to the HOA for the information disseminated on these forums, even if they are not directly controlled by the HOA. The HOA is being sued by this individual. Seems to me that if the HOA allowed personal (even if publicly available) information about this person to be posted and discussed on these forums, it could be perceived as an endorsement of the comments on these forums, which would not look good to a judge/jury. I am actually surprised that this thread has not been locked and/or deleted yet.

    I edited out the superpages link because yes, while the information is readily available, it wasn't necessary to 'hand it out' packaged and all. I believe it was just more of a respect someone's personal information, rather then 'this is forbidden!!!!'. The person has made their name public through the lawsuit, but we don't need to take it further then that. Yes the information is available if someone wants it.. so let them go get it if they are truely interested.

    There are things on the internet to tell you how to make pipe bombs, etc.. so it's publically available.. but I don't think that means it should be linked here.

    Remember.. the rules also state

    "The Brodlands HOA reserves the right to edit or remove any postings, or user accounts, for any reason whatsoever"

    Not to mention what I already said...she seems to be in the habit of filing frivilous and baseless lawsuits already, why not add another! Better to keep it to yourself, in my opinion.
