trepassing and noise issues, help!

    The tenants renting my neighbor's basement love to throw party on Saturday night.

    Whenever they have a party, their guests usually cut my driveway and lawn and get onto the walkway to the basement since my neighbor parks her vans on her own driveway and it is not convenient for their guests to walk through.

    I have talked to my neighbor about this but their tenants and guests still keep doing this. I feel tired to sit up there whole night to wait for their party to be over and catch anyone who cut my lawn.

    I find out a "trepass notification" on Loudoun County Sheriff's Office at

    Does anyone know how to use it?

    Also, my neighbor's tenants were having some sort of party last night. The music they played is so loud (sound like the music you will hear in pub and karaoke) and they talked and yelled in the backyard after 11:00PM (went all the way to almost 1:30AM).

    We have no idea what we shall do since we don't know who they are and scared if they are drunken.

    We try to be a nice and understanding neighbors but these seem to be too much for us.

    We appreciate any advice from you all in this forum.

    Any noise that is audible beyond the property line, especially late at night, could be deemed a noise ordinance violation. Maybe you should call the LCSO non-emergency line at 703-777-1021 next time they throw a party if you think it's too loud. Dealing with the people cutting through your yard and/or driveway would be a little tougher to address because they'll be gone before the cops arrive.

    LOCO is still rural in it's policing and civil laws. Which means you can't even think about calling the police for noise until between 11pm and 5am.
    During all other hours you could have Metallica in your back lawn and your neighbors can't say boo.

    The only option is the HOA. Your neighbor is infringing your enjoyment of property and that is in the covenants.

    Earl4, Homer Simpson, and vacliff, thank you all for your advices on this.

    I also checked with my friends and they suggest I shall call the police and report the noise next time.

    I feel bad for my neighbor but she leaves me no option since she fails to do anything to quiet down her tenants in the middle of the night (she also lives in the same house and I believe she heard it).

    Earl4 and Homer Simpson, I agree with you and I was was thinking if it will help if I collect evidences (taking pictures and/or video) by myself since one of my neighbor's tenants keeps taking my driveway and lawn as his shortcut.

    When I saw this "trespass notification" and wonder if I shall give my neighbor's tenant this notification when I catch him next time (I had informed my neighbor but it does not seem to help.)

    I am just wondering anyone use this before. Shall I keep a copy? So when my neighbor's tenant does it again, I could show the police officer the pictures/video and the notification.

    Here's a concept that you might want to try instead of automatically going to the police...talk to the tenants yourself. I realize this may be a radical idea, but talking to people has been known to work for solving problems in the past. I can understand if you don't want to talk to them if their drunk, but try during normal hours when they are sober. you just might be able to solve the problem without getting the law involved.

    terps, the notice of trespass is more of a first step in getting a restraining order against some who is harassing or stalking you. It's not meant to keep random party guests off of your lawn.

    I agree with Baywatch, talk to the people who your complaint is with, not the owner. If you approach them in a cordial manner, I think you'll be pleasantly surprised by the outcome.

    Not exactly true, Cliff. You did send a leter to my neighbor who had his rock band in the back yard on easter sunday upon our request. You may have chnaged your policy and that is a pity as LoCo will not help.

    In some cases, with continuing problems, we can send out a letter. If someone needs action taken about late night activities, the HOA isn't the place for help.

    I found some glass from a smashed beer bottle in my backyard.

    I suspect that is from my neighbor's tenant's party last Saturday night.

    Is it common that there will be something from the party like this in neighbor's yard after party?

    It's been known to happen. I remember finding a dead crab in our backyard after our neighbor's had a crab feast.
