    Hey maybe if this dude took the sand bags from the BB net and put it over near the sledding hill, it would stop the kids from sliding into the street. Come on Cliff be creative! You get ride of the BB issue and solve another.

    while i understand why the sand bags are an "eye sore", i'm not sure the guy needs to be fined by the HOA. this is why some people don't like HOA's. of course no one likes it when you're the one being gone after---everyone loves it when they can send someone else after the neighbor who uses sandbags to hold down his basketball hoop.)

    the way i see it, the basketball hoop is the eye sore--but that's just me!

    now---how do i hide this blasted trash can??? :)

    But the HOA only fines after 3 notices are sent out and ignored. You get a 1st notice then a reminder notice and then a notice of a hearing before the HOA board. If a problem still exists after the aloted time to fix it or you do not acknowledge any of these notices then the HOA fines you (normally at least a 90 day process). If at any time you acknowledge any of these notices and either say you are working on it it will take X number of days to comply or that you do not agree with the ruling and wish to take it to the board for further discussion nothing happens until the whole process is over. This person does not even go before the board until March (according to the article) so he does not even know what they may say so I am not sure why it is in the papers at all except he does not like the rules he signed into.
    as a side note - simple mathmatics will tell you that putting things on top of a portable hoop that is unstable to start with will only make it more unstable by changing its center of gravity. So the way I see it the HOA is protecting there own a** for when this thing is dragged onto HOA common area and then falls over ontop of someone and they are seriously injured.

    The homeowner was quoted as saying he drives around Hendon and Sterling and sees sandbags everywhere. Point made. The rule is there for a reason. :D

    I remember the neighbor's hoop when I lived in Broadlands falling down during a number of storms with heavy winds, they also only used sandbags to keep them up.

    I love the part in the paper, where this person was quoted in the paper that : "During a particularly windy day last winter, Gupta's basketball pole fell on a guest's car in the driveway, causing several hundred dollars in damage. The claim was paid by his insurance company.

    At the time of the accident, the base was partially filled with water and secured with two sandbags. Gupta said he now uses seven sandbags and has not had problems."

    Yet the manual states "Reebok's online instruction manual recommends filling the basketball pole base with water or sand and using ropes and stakes for extra stability. It also advises laying the pole on the ground during inclement weather."

    Sounds like the pole falling down is the guys own fault, not following instructions.

    Exactly ... if you want to live in Herndon and Sterling without HOAs, and neighbors who can do what they want (junkers on lawn, pink and purple shutters, overgrown weeds), do so. I would try doing the sandbag thing in Reston and see what happens.

    Cliff and the HOA are right on this one. The sandbags are an eyesore, and the fact that you seem them all over Herndon just validates why we moved from Herndon many years ago.

    Way to go, Cliff, and the HOA! Fine this flippin' guy until he gets a clue!

    I would be curious to know if it fell over last night or this morning with the high winds. If seven bags are not enough will he add more?

    If he wanted a permanent hoop he should have bought the in-ground type.

    There is also a stipulation in the HOA guidelines stating

    "The preferred location is over a driveway, a minimum of 20' from the nearest property line shared with a residential lot".

    From my observation that rule is violated even more than the sand bag rule..

    "preferred" in not a definitive. It would only be a violation if the wordage stated Must or Shall. When all is considered, most basketball hoop applications are approved.

    Just out of curiousity, does VDOT have any rules about basketball hoops in proximity to roads? I thought that I had heard something years ago.

    I understand your point but the "preferred" location should be a consideration in the approval process. If the placement of the pole would be within 20 feet of the property line then I feel the affected neighbor should have a say in the approval. Forgive the rant but this has been a thorn in my side. Here in Overland Park the driveways are at best a few feet from the property line. We had a neighbor who put up a hoop on the outside edge of their driveway (with sand bags) which put it roughly 12 feet from my house. Errant balls destroyed several plants and were consistently bouncing off the side of my house. One time it happened while the father was out there. When I looked at him hoping for at least some type of apology all he did was shrug it off like "sh*t happens". Thankfully they have since moved. I really don't have a problem with kids shootin' hoops but at least be considerate enough to put the hoop on the other side of the driveway so errant shots end up in your own yard.

    So what ever happened to the 0ones we had when growing up where the backboard was attahed to the house above the garage? Uh, Oh I guess that was less of an eyesore back then when we actully had mature trees around the houses.

    Would be less expensive and not so much of a pain for some people. Having a nice looking community is nice, but so MANY rules make for less fun.

    Attached to the house are allowed also. Again, based on meeting design conditions.
