Andrew I in no way bashed cui. I do however take exception with his method. Imagine for a moment you take significant time out of your busy schedule every month to volunteer your time to help run this community. Then someone in the community refers to you as an "overlord". There are many ways to solve a issue in our community. Coming on the community's message board to sling mud is not one of them!

Thanks for the explanation Staci. That totally makes sense. Kudos to the Board or the modifications committee or management for coming up with the idea.

Hrm, Well those homes built by VM that did have courtyards...that's all contained in the orignial buyer's contract. I did not know that if I hadn't done things right that the new owner whould have to jump thru these kinds of hoops. Good thing I DID get modification forms put through.

I did get letter for our fence being too far out on one side a year after it was installed. The fence builder looked at the HOA guidellines for directions and built it. We had to pay $1500 to get the entire side of the fence moved back in 3 feet. Even though the we thought the guidleines had been followed and our fence app was approved with our drwaing of where it would be.

As hard as that was, I'd never expect that to happen to whomever would buy our house in the future. Buyer beware..and read your docs that we have to pay 100 bucks for when we sell our house to you.

I think that the $50 should be waived/absorbed since it was of no fault to the current homeowner and was missed when the house was sold.... If we make "up to $900" in fines for current homeowners who don't comply... making up for the $50 shouldn't be a huge deal. *shrug*

    Re: -Fined by the HOA

Anyway you look at it he needs to take his complaint to the HOA board of directors to get a resolution. It can not be done here with public opinion or at this time by the staff (who only followed a process the board put in place). His next step is as Maureen and I have stated he needs to write a letter of complaint to the board and we can determine a resolution with all the information/ facts.
