I spoke with a VanMeter rep. about moving the trees back from my property and they refused to move them because they say its a county plan and they cannot be removed. Whatever deck/patio I want to put in is already limited by the county setbacks, now I have to go even smaller cause of some damn trees I don't want on my property. Does anyone know of any action I can take to get them removed? Any advice is appreciated.

from what I understand, any trees that you remove need to be replanted. for example, you want to remove 4 trees from your backyard, you need to plant 4 trees somewhere else on your property.

I'm with you, beahmer, 100%. I wouldn't even think twice about doing this. Even if replanting the trees in a new location were against HOA guidelines (which I doubt), the chances of the HOA finding out about this are on the low side of between slim and none.

I agree, but since the backyard is so small, after the deck and patio there won't be any space available. There are 3 trees that would need to be moved. Van Metre refuses to relocate the trees outside the property line.

My guess is that if one or more of these trees disappeared, no one would even notice the difference.

You know, you could always "prune" them, WAY BACK...like to 6" tall!

the question would be if they're in the VDOT or county required buffer. some of those houses actually have a landscaping easement on their property -- just like a drainage easment. If VDOT decides to come in and plant (or fix the drain) they can legally wipe out structures. Check your plot.

Not knowing where you are located or if you abut a road or another property outside of Broadlands, I really can't make firm comments on whether or not you can move the trees.

But as someone mentioned previously, there are landscape buffers that must be maintained per the County requirements. And if this is one of those cases, you couldn't build your deck in that location anyway.

Could you explain where you are located and what abuts your yard ?

And what is it with 'taking down trees' anyway ?? Did everyone grow up in areas where there were no trees along the road, or mature trees in the backyard that provide shade and cooler temperatures in the summer ??

I'm lucky .. my 80 ft wide by 20 foot deep back yard abuts one of the wetlands, and I have plenty of trees in my backyard, yes, the last 5 feet go into the wetlands and are covered in trees.

In the summer mornings, they shade the backyard, and back of the house, and its much cooler there than it would normally be.

I back the wetlands as well along the bike path. I have no problem with trees and welcome them. I had plans to build a deck and patio pre-tree planting and had a couple of contractors come out before the trees were planted. Now with the trees I have to start the whole process again. I asked Van Metre to move the trees off the property because there is room just outside my property line, but they refused. There are already 5 or 6 pine trees just outside my property.

Again, the county requires trees in the back of the house for easements, tree cover requirements, etc ... not knowing what your plat looks like and what easements there are on the property, any other comments would be speculation.
