My builder recently worked on a pond adjacent to my property and took my side yard away. My side yard is mostly not accessible for turning into steep slopes or part of the pond.

Since there are so many issues on the work, I contacted HOA and Loudoun County and learn that this construction plan is not approved yet, technically.

I know County has the right to perform some work on the easement. However, I don't know if builder has the right to construct and take my land away before County approves the plan and without my consensus.

According to the County, they would like to talk to the builder and find out why they work on the site before the plan is approved. Then, the County will discuss with the builder how to improve the plan.

For me, I would like to consult an attorney what my right is after all these damages.

If you might know any good real estate lawyer that you would recommend, could you please reply this post or send me an email at terpskuan@gmail.com

    Thank you in advance!

I just worked with a fantastic law office- Stein Sperling, and spoke with one of the partners about your post- she recommended that you contact"

    Beth Irving at 301-838-3224

and she can guide you in the right direction.

This office did an amazing job for me recently and I highly recommend them- one might say that they pass with flying colors! :)

Thank you, redon1, for this information and discussing my situation for me!

I was just in contact with another law firm that my friend recommended (nothing starts yet). I will definitely contact Ms. Irving if there might no progress on that side.
