Three Daycare Workers Charged with Failure to Report Suspected Child Abuse/ Neglect

    Loudoun County, Virginia- Three employees of a daycare facility were charged last week with failure to report suspected child abuse or neglect; an unclassified misdemeanor.

    Linda E. Smith, 53, of Reston, Estrella Levy, 35, of Dumfries, and Adrienna Ballato, 28, allegedly had knowledge of possible child abuse that took place at the Kinder Car Day Care Center on Waxpool Road in Ashburn on January 22, 2008. A third-party witness stated they saw a teacher shake a toddler. Smith, Levy, and Ballato allegedly were made aware of the situation but never informed the Loudoun Sheriff’s Office or Child Protective Services; which is required by law.

    Smith, Levy and Ballato, are all managers at the facility. All three were charged on April 28, 2008.

    The charge is an unclassified misdemeanor and is punishable by a fine up to $500. Virginia State Code 63.2.-1509 states the following persons (including any teacher or other person employed in a public or private school, kindergarten or nursery school) who, in their professional or official capacity, have reason to suspect that a child is an abused or neglected the child resides or wherein the abuse or neglect is believed to have occurred.

    There's an error in this article. The incident took place on Jan. 15th... not Jan 22nd.
