The sealant /rejuvenator is extremely toxic. Avoid exposure to vapors especially if you are asthmatic.

Unfortunately this information is incorrect. I wouldn't advise licking the asphalt or drinking the rejuvenator certainly, but the vapors are not toxic. As most within the industry already know, coal tar is eminently safe for use in a wide variety of construction projects. All airborne contaminants given off by coal tar products are well within the acceptable limits. OSHA, in fact, has given the all-clear to companies that use this material. Most of the health risks have been linked to unrefined tar, which is not used in pavement projects. The refined coal tar products that are in use in the asphalt industry have been specifically manufactured for asphalt pavements.

The Material Safety Data Sheet can be found - just google Asphalt Rejuvenator. The precautionary statements are listed by the manufacturer with no third party independent study to dispute them. Run-off into our streams/environment is another hazard.

If I am mistaken, please post the MDS here. They should have given you a copy when the contract was signed.

Rejuvenators have been used for the past 40 years with the FAA and oversight by the EPA. Once the product penetrates into the asphalt, it’s absorbed up to 95%. It’s not like other coatings that can chip off and go into the environment. In fact, the plant in Texas where the product is manufactured is next to a lake which is continuously monitored by the EPA and the EPA inspects the plant multiple times a year. The plant has been certified green.
