Evanger’s Sues Meat Supplier but makes a BIG Disclosure

Evanger’s Pet Food company files a $20 million lawsuit against its meat supplier, but in the court documents the pet food company discloses they directly lied to consumers. The meat used by Evanger’s was labeled “inedible”, it was not ‘human grade’ as the company told consumers and retailers.

The lawsuit – Evanger’s Dog and Cat Food Company v. Bailey Farms – claims meat purchased by Evanger’s from Bailey Farms was mislabeled, not as the pet food company ordered and not as the meat supplier labeled the meat on invoices.

The suit states Evanger’s paid $15,789.30 for 42,340 pounds of “inedible beef” (for about $0.37 a pound). The lawsuit claims two shipments of meat (linked to the recall of Evanger’s Hunk of Beef manufactured in 2016 and linked to the recall of Against the Grain manufactured in 2016) were mislabeled; due to the supplier stating “inedible beef” on product documentation when testing found the shipment contained horse meat.

And the suit claims the meat supplier misled Evanger’s by providing an expired APHIS (Animal Plant Health Inspection Service) number on all invoices when it was later discovered that number had expired.

Should all of Evanger’s evidence prove to be true and accurate, it appears this lawsuit is legitimate – it appears Evanger’s has a legitimate claim against the meat supplier for mislabeling euthanized horse meat as “inedible beef”.

But…

What about Evanger’s mislabeling? What about Evanger’s knowingly purchasing “inedible beef” and telling consumers the meat was “Human Grade”?

In the Evanger’s v Bailey Farms lawsuit, Evanger’s made this admission…

In late May, 2016, Sher placed a verbal order for beef with Bailey. On June 2, 2016, Bailey delivered via common carrier, CH Robinson, 42,340 pounds of “Inedible Hand Deboned Beef.” Inedible indicates only that the beef was not for human consumption; meat for human consumption must be processed in a facility that is certified and inspected for human food by the United States Department of Agriculture.

These words are significant: “Inedible” – “not for human consumption”.

Evanger’s has initiated a $20 million lawsuit against a supplier on the grounds they were lied to. What about all the consumers and retailers that were lied to?

As of January 30th, 2017 – Evanger’s was telling consumers their meat was human grade – when the invoices on their meat purchases stated “inedible”. Inedible meat is NOT human grade.

What about that mislabeling?

Evanger’s knowingly purchased “inedible beef” and told consumers and retailers (through marketing materials) the pet food was made with “Human Grade” meat.

What about that lie? Will Evanger’s be held accountable for lying to consumers?

Regulatory authorities have done nothing thus far to hold Evanger’s accountable for the false “Human Grade” claim on Evanger’s website and authorities have done nothing to hold a supplier accountable for mislabeling euthanized horse meat as “inedible beef”. It’s time for regulatory to step up and take action on behalf of consumers. No company should be able to walk away from knowingly and directly lying.
