    So because their original claims in the lawsuit are basically made moot - they now file an injunction to try to muzzle Cliff.

    Maybe the Briggs should sue the State Senators for stating stuff they don't agree with. Heck, lets sue the President as well.. 'he doesn't speak for us'

    Maybe we should let the Briggs family handle their own concerns. They have a right to take such action.

    If they were worried about others in 'their own concerns' they wouldn't be calling the press to seed articles before they file court papers.

    What difference will it make in the final approval if the HOA board says nothing about the hospital?

    Does the HOA hold a lot of weight into the approval?

    Is this gossip or a fact that the BiggsFamily or lawyer called the press prior to filing the lawsuit?

    As the article reads it does call into question the Owner Agent status and if our HOA documents allow for the transfer than the Biggs suit has little merit.

    It's fact. Presumably it would be the lawyer, not the Biggs making the contact though.

    I still get a kick out of the original stories though. Are the Biggs just the ones willing to put their name down.. looked that way from the lawyer's quote. He was ready to file suit.. he just needed bodies to fill in as plantiffs.

    The ambulance chaser that filed this frivolous motion is a Broadlands resident! Can't wait to find out how much of our HOA dues will be wasted defending this ridiculous claim.

    The judge stated: "I still have a hard time dealing with, what's the harm?" Horne said. "What's the impact?" Here is the story from Leesburg Today.

    I would love to see the Broadland's HOA counter sue the Biggs for damages. Most rewarding would be the discovery. Discovery that would prove beyond a reasonable doubt that this entire effort was funded by INOVA. It's so transparently obvious.

    Donna and Mr Biggs both got comments in the follow up articles.

    I especially like the quote about destroying the spirit of the community.

    I can't wait for the cries of bloody murder as the rest of the undeveloped commercial property around the neighborhood gets cleared and developed. Along Demott... the property along Broadlands Blvd closer to Claibourne.. etc

    'No Development' is not an option.. unless someone finds someone with hundreds of millions of dollars willing to buy up all the property and just not develop it.

    I hope we all recognize that "no development" is not an option. But by the same token, development needs bo be in accordance with the approved concept development plan for our community. A hospital was never part of that plan! HCA knew that when they bought the Fallen Willow property, particularly since their law firm was the same firm that got the property rezoned almost a decade ago. If BRMC doesn't get built, it will likely be at least another decade vefore something else is built. And that development will have to comply with the existing zoning ordinances and proffers attached to the property. Those ordinances and proffers do a lot to protect Broadlands residents from undesirable uses of the property. The existing ordinances require tree save, setback, landscaping, and open space requirements similar to those BRMC is proposing.

    You do know that their are NO proffers and very minimal requirements for this property if not for this application. And there is NO tree save area this is only part of BRMC's proposal. All that is required is a 50ft buffer which does not mean trees. Take a look at the surrounding centers only CLyde's was built with a special exception (and many people fought that too saying it was not part of our concept plan) the rest were clear cut by-right development.
    Also there is a really good chance that if this property is not developed by BRMC that whom ever buys it will need NO public input before building so we will get NO say in the next round.

    So you're just betting you will not be here anymore so it won't be your problem? NIMBY at it's finest! What are you going to do when the rest of Broadlands Blvd is developed?

    Bzzzzzzzzt. Take a look at Lee's favorite right across from Regency for just how bad 'by-right' can go.

    I stand corrected on my statement about the tree save area. The proffers for the property do not require tree save. however, they do require a 50' buffer with Type II/III landscaping. If you look in the zoning ordinance, Type II/III landscaping does require trees at several different canopy levels and recommends using as much "existing vegetation" as possible. As to the proffers, there are in fact multiple proffers associated with the property. A few of them include:

    Proffer I.1: Requires development in substantial conformance with the approved Concept Development Plan (which does not include a hospital).
    Proffer I.4(b) requires a pedestrian pathway to be constructed along the north side of Broadlands Blvd.
    Proffer I.7 requires a landscaping plan be submitted for each site providing landscaping, buffer and screening of outdoor storage areas, loading areas, and parking areas from public streets. Minimum plant specifications are also specified in the proffers.
    Proffer V.B.42 requires the developer to dedicate to the County one half of the right of way necessary for widening Rt 659 to a 120-foot width.

    And there are many other proffers associated with the property. I understand that HCA is offering additional proffers (as well as wanting to change some of the existing proffers), but to imply there are no current proffers is simply incorrect.

    Concerning your comparison with Clydes, there is a major difference. That information was provided to potential buyers, was featured in the brochures provided by the developer and was displayed at the visitor center for all to see. The Hospital, on the other hand, caught many of us by surprise. It is interesting to note that there is no mention of a potential hospital location on the current site plan available on the Developer's website even today!

    You appear to be implying that we should support the hospital because we are able to provide input on their site design -- which is only because they need a zoning change and special exception. And that even if this is not the right use for the property we should accept it because we get to have input into their plans. I'm sorry, but I don't buy that. I am willing to take my chances with the current concept plan, which does provide protection to the residents of Broadlands.

    For the record, I have no affiliation at all with Inova, other than having availed ourselves of their services (as we also have of HCA Reston). I would oppose Inova or anyone else if they wanted to build a hospital on the same property. I am one of many concerned residents who believe this hospital does not belong here given the Concept Plan for this community -- a plan that was an important element in our decision to buy in Broadlands.

    a pathway
    a written plan
    and a road right of way with zero dollars to actually DO ANYTHING with that right of way

    I can't believe you actually took the time to list that out.. its a pathetic list if you are trying to show that a by-right development would even be comparable to what the current proposition is.

    Wow, does that mean by right will give us the same buffer provided by Clyde's? I hope there's not another dumb horse involved.
