Violation for "building materials" in my driveway

    James Hardi is fixing my siding and dropped off about 1/2 ton of siding for the repairs. It was there all of a few days when I get a violation in the mail. The work has now been completed and the siding was removed (prior to getting the letter), but really? Trust me, I'm from WV and I know what other people can do to your property value, but how can you not have building materials at least for a brief period. I think the timeline of how long the material can sit there is what should be defined. If it was a project I had to apply for through the HOA would that have granted me more leniency? Overall, I support the rule but not sure how anyone would get anything done. The way the letter was written was "during an inspection", what if it was delivered that morning? I live on a busy street and do feel that I'm held to a different standard than some of the culdesac streets.

    I agree; there should be a specific time frame for a violation to exist, perhaps 48 hours, before a notice is mailed to the homeowner.

    Agreed! Hopefully violation letters are also going out to the homes with broken fences, overgrown landscaping, half stained decks, etc..

    Letters are definitely going out for trash cans being out. I was tagged for that and have since brought them in. I was in the wrong and they must have done it to everyone because now I see no trash cans outside.

    I think you will find the association is generally pretty accomodating when they are notified either via Modification Application or when a resident advises that something like this is happening. Short of that, if we had to double/tripple check everytime we found something we would have to significantly increase the staff to do so. Considering some folks wouldnt think twice about piling stuff in their driveway for weeks (we seen it all) this is why when the inspections are done the letters are written. There are very specific steps the association must follow and if you happen to be a person who would leave it there for weeks, until you get the first letter which starts the process nothing else can be done.

    On the comment about a perscribed period of time that can work to and against you. Lets say we had a hard and fast rule of 3 days and your contractor flaked out - now youre in violation. The best thing to do in these situations is a simple call or email to the association staff letting them know whats going on and indicating the materials would be there for a few days until the contractor finishes the work

    Maybe a simple call or e-mail is the "best" as we thought, but certainly not foolproof. Our sidewalk lampost died so we called the office to let them know it would probably be close to 8 days before we could have it replaced. Three days later, we received a violation for the lampost light being out.

    And don't forget, most of the violations cited are reported by your neighbors. The inspectors would have a difficult time keeping up with the whole community.

    Sorry to hear about this - perhaps the letter was already in process when you called and got missed - cant speak to specifics but I can say as a Board member I would rather have had a letter sent in error than to hear that something has gone on forever without a letter - IMHO.


    In many cases this is quite true. Further making the point that just because one person doesn't feel it's a "big deal" there might be ten more that do.

    Okay well, how come the people that back up to Broadlands Blvd (practically across from Clyde's) with the huge side yard have huge horizontal lights nailed to their trees, and their fence is falling apart? I walk by there every day and it has looked really bad for over a year.
    I think building supplies in the drive way is not a big deal. Work is being done.
    There is a house on Vestal's Gap that has those huge clean up bags that have to be picked up by a truck I assume, in the street in front of their house for about a month.
