Portion of neighbor's fence on our property

    Hi All,

    We moved into our home late last year and noticed our neighbor's fence comes into our property by a little over a foot (1.1' according our survey from a few months back). The back corner of the fence is on the lot line, but it the rest of it then juts out into our property taking a triangular sliver out of our yard. The fence was built before we moved in, probably a couple of years ago when the previous owner was here. A foot may not sound like much, but that's the only side of our house we can walk around to access the backyard. It also affects how much space we have to plant a flower bed along that side of the house and if you visually follow the line of the fence it makes the rest our yard appear much smaller (on an already small lot).

    Has anybody else had experience with resolving an issue of a neighbor's fence on their property? There are currently renters in the home with whom we have a good relationship, so we'll probably have to mail a letter to the owners to get this taken care of. Is this something the HOA can help us resolve? I'm guessing the expense won't be huge as the portion of fence that needs to be moved is relatively short. It's really something the fencing company should have done correctly in the first place, but alas that's not the case!

    I'll leave out the details where I think VM moved a spike, but...

    when we had our fence built, we measured it out, staked it, string and all with the fence builder. A year later our back door neighbors decided to build a fence using the same company. Turns out that a portion of our fence went into their yard at an increasing angle. So, our neighbors told us about and we verified with the fence builder that it was in fact on their property (using our surveys). We had the majority of the back portion of our fence taken down and redone along the correct boundary line. Sure we shelled out $800+ to do it, but it was the right thing to do.

    I'd say to mention it to the owners and see if they can contact the fence builder to get it rectified if it truly was the fence builder's fault.
