Need Help! Residents on Awbrey

    If your kid was wearing shorts and a back pack and left the house this morning around 9:30 to 9:45 tell him to stop walking through my back yard and climbing my fence to get to Truro.

    I don't need the liability of him falling and getting hurt.

    Are you aware that HOA has allowed residents to post no trespassing signs now? That will protect you from liability if the trespasses and gets hurt on your property -

    what’s more, you can sue his parents if he damages your fence or property!

    Most of the time parents won’t rectify it believing their kids didn’t cause the damage and if there is no video, you are out of luck.

    That's when you’ll have to take them to small claims assuming you have a witness who saw him trespassing and damaging property.

    It all boils down to whether one has the time and temperament to go that far but some folks may just file a police report but most cops can’t do anything about it unless there’s a witness or video. It’s basically your word against the kid’s.
    A number or kids today don’t want to get in trouble so they’ll deny they did it unless you have a video to show their parents (if you happen to find out where he lives!).

    If you saw him, why not address it then and there? Most kids are thinking in the moment and not about consequences.

    Because by the time I see him and get to the door he is over the fence.

    I think it would be better if his parents are able to address if they know. If I can catch him in time I will.

    BTW, this is the HOA fence. Not mine. If he damages it, the HOA pays.

    Update: I was finally able to catch him in the act and informed him that he should not be in my yard going over the back fence. Looks like he understood. I haven't seen him since.

    But the thing that got me was that his attitude was like he didn't think he was doing anything wrong. Kids today.
